794 (775 pounds sterl of lawfull English money the like value being recd here pray make good payment and place the same to the Act of S.t To M.r Arthur Gough at the Your Loving Kinsman sign of the Thatch'd house and humble servant Tavern in the Strand Mar Gough London Decemb.r y.e 16.th 1696 That what person soever shall discover any disturbance likly to happen within his M.ts Governm.t shall have A Reward of 20.ℓ Ste.ll and if a party concerned shall have his pardon The above is a Clause contained in a Certain Ord.r of Councill of y.e above Date issued & sent to each respective County of y.e Province Hen Denton Clk Councill Sworne to in open Court by M.r Chr Gregory Denton as A true Coppy To all psons to whome these p.rsents shall come toe y.e subscribers being Justices of his Maj.tyes Prov.ll Court of Maryland send greeting &c.a His Ex.cy Fra Nicholson Esq.r his Ma.tys Cap.t Gen.ll and Govern.r of this Province having been pleased to produce a Certaine paper before us intituled A Peticon of M.r Phillip Clarke of S.t Marys County and by severall Evedences sworne before us declared by them that it Looks verry like And they believe it to bee y.e hand writing of y.e s.d Phillip Clarke w.ch Containing in it Many falce scandalous and Lying reflections As well on his Evi.ces the Gov.r as on y.e Court Wee hold Our selves Oblidged for y.e true Informacon of these whome it concerns and for vindicacon of y.e Govern.rs hon.r and Integrity in these Matteres to sett fourth and declare as hereby wee doe Unanimously and severally declare that y.e s.d paper let who will bee y.e Author is A falce and scandalous Libell 1 In saying y.e Govern.rs prejuduce supposed to be concieved ag.t y.e s.d M.r Clarke was for his refusing as Judge of y.e s.d Court to grant a Judgm.t ag.t John Cood Contrary to Law most invectively falce & untrue the s.d Phillip Clarke being not Judge of y.e s.d Court Nor did y.e Govern.r Ever Move y.e Court in y.e Matter or press them to give any kind of Judgm.t Nay soe carefull was y.e Court in that Matter that when y.e Kings Councill at Law moved for an Attchm.t ag.t y.e s.d Cood for y.e penallty of an Act of Assembly being 20.ℓ sterling upon two Non Est Inventus returned & a bill found by y.e grand Jury Yet y.e Court would not grant it because there was Criminall Matter Mentioned in the bill Nor would would y.e Court grant an Attchm.t ag.t y.e s.d Cood for y.e Kings D.t sued for till a Declaracon filled Coppy left & two Writts returned y.e s.d Cood not found and every part of y.e Acts of Assembly Answered 2 In saying that y.e Govern.r came downe to y.e Courte foure days together and did there Endeavo.r to prove y.e Pet.r guilty of crimes that might deserve Imprisonm.t but that after all his threats y.e Evidences not swering what he desired was disapoynted of his designe we say its desperatly falce and untrue for y.e Govern.r did not come foure days to y.e Courte nor more then two and y.e cause of his comeing he declared to bee to give y.e Country an Acco.t that he had rec.d sev.ll advises which Indured him to believe there was some ill minded psons in S.t Marys County indeavouring to raise disturbance & disquiet in y.e Governm.t and becaus he s.d there was some psons in Court that could prove severall detraiting and villifying discourses and Expressions of y.e Governm.t which is generally the forerunners and instrim.ts of disturbance he caused them to be Examined before y.e Court & Country which by the Governo.r did Either threaten or pswade Either y.e Courte or Evidence is most impudently falce And we dow verrily believe that y.e Govern.r principall Justice to be soe carefull in that Matter was to p.rvent disturbance and to p.rserve peace & quiet in y.e Province for soe he declared 3 In saying that proclamacon was issued out promising a reward of twenty pounds to any that would swear the Pet.r was Endeavouring to raise A rebellion in S.t Marys County Wee can only say We Never heard of any such proclamacon and presume if such had been some of us should have seen or heard of it wee have all heard & seen a proclamacon about y.e time issued declaring that in regard there was suspisson of some practuss on foot in S.t Maryes County to raise rebellion That therefore if any pson know thereof and would come and discover the same they should have twenty pounds sterling reward and if they had been engaged therein should have theire pson for y.e same by which proclamacon We |
