774) 793 Memorandum Nov.r 17.th 94 The Agreement between John Prout and Catherine his Wife is That after all the Debts of the afd John are paid and the Charge of all his p.rsent Law suits and pticularly this late suit between him and his wife defrayed there shall be a division made of all the Goods and Chattells and in a word the whole Estate and Substance all the Lands Cows and Horses hoggs and other moveables and Immoveables whatsoever of and belonging to the said John and that after such Division of the s.d Goods and Chattells &c which shall be into three equall parts by two honest neighbours one to be chosen by the s.d John and the other by his said Wife Catherine she the said Catherine shall have one third ^part^ of the whole Estate to her share and her said husband two thirds and that upon the receipt of the s.d third part she the s.d Catherine shall utterly leave and be totally seperated from the s.d John her husband and provide for herself Likewise that the s.d John shall now forthwith and Immediately upon demand Give and deliver up to his said Wife Catherine one Gray Mare called Jenny and her Cost as pt of her thirds and that he shall pay all his Debts and the Charge of the af.d suits within the space time and tenure of one year after the date of these p.rsents on Condicon that she the said Cathrine doe now forthwith leave him and his house and provide for herself wittness our hands and seales Testis Tim.o M.ccNemara John Prout (X) seale his marke her mark Michael W Chivers Cathrine (+) Prout (+) seale Recorded Aprill 30.th 1697 H Wriothesley Clk Maryland May the 6.th 1697 At Thirty days after sight of this my second bill of Exchange my first not payd pay unto M.r James Round or order the sum of Four pounds Twelve shillings sterling being for the value recd make good payment & place it to Acc.t of s.d Yo.r humble servant To Cap.t Edward Barcock Nevinson Taylor living in London Exc.a for 3.ℓ 6.s 8.d Virginia y.e 6.th of May 97 S.t At Twenty days sight of this my second Bill of Exchange my first of the same tenour and date not being payd pay unto James Rounder his order the sum of Three pounds six & Eight pence sterl money of England value here already recd make good paym.t & Charge to Acc.t of yo.r friend To Edward Barcock Edward Barcock in London Virginia May the 6.th 97 Exc.a for 10.ℓ 00 00 After Ten days sight of this my second bill of Exchange my second first not payd pay or Cause to be payd to M.r James Round or order the sum of Ten |
