755) 773 Statute for Transferring uses into possession And to his heires All those Three plantacons Conteyning by Estimacon Nine hundred Acres (he the same More or Less scituate lyeing and being in the said County of Calvert in Puttuxant River in the s.d Province of Maryland) which late were the proper Estate of the said Richd Charlett Deceased and all Messuage or Tenements Edifices buildings outhouses Workhouses Woods Trees profitts Comodityes Wayes passages emoluments and hereditaments whatsoever standing or being in or upon or in any wise belonging to or used or enjoyed with all every or any y.e said premisses Together alsoe with all and every the utensills tools implements and Materialls whatsoever belonging unto or used in or upon or above the p.rmisses or any part thereof All which s.d p.rmisses were by the Last Will and Testement of the said Richard Charlett given and bequeathed amongst other things to the said John Charlett Katherine Kings Mary Salter and Frances Bryan (And also to him Charlett y.e other of the sisters of the said Richard Charlett that was Liveing at the time of his Death Makeing the said Last Will and since then Deceased without Issue) to be Equally Divided Amongst Then & all the estate right and title interest inheretance property profitt Claime & Demand whatsoever of them the said John Charlett And Mary his Wife Richd Kings & Katherine his wife John Salter and Mary his Wife Nathaniel Bryan and Frances his Wife or any of them of in or to the said messuages plantacons and all and singular other the p.rmisses herein before menconed or of in or to any par or parcell thereof with their & every of their appurtenances by vertue of the s.d Will or otherwise howsoever To have and to hold the said messuages plantacons & all & singular other the p.rmisses with their and every of their appurtenances unto the said Edward Carleton his heirs and Assignes To the onely use and behoofe of the s.d Edward Carleton his heirs and Assignes for ever And each of them the said John Charlett Richard Kings John Salter and Nathaniell Bryan for him selfe and his Respective Wife And for their severall and Respective heires Executo.rs and Administrato.rs severally and Respectively and not any of them for and with the other of them or for the Act or Deed of any other of them the said messuages plantacons and all & singuler other the p.rmisses with their and every of their appurtenances unto the said Edward Carleton his heirs and Assignes against them the s.d John Charlett & Mary his Wife Rich.d Kings and Katherine his Wife Respectively and their severall and Respective heirs and Assignes And against all & every other person and persons Lawfully Claimeing or to Claime ^by^ from or und.r them or any of them or by from or und.r the said Richard Charlett Deceased & his heirs and Assignes shall and will Warrent and for ever Defend by these p.rsents And the said John Charlett Rich.d Kings John Salter And Nathan.ll Bryan Doe for themselves severally & for their severall wifes And for their severall and Respective heirs Executo.rs & Adm.rs severally and Respectively and not any of them for or with any other or others of them or for the Act and Deed of the other or others of them Covenant promise and Grant to & with the said Edward |
