750) 767 Ursula Hows Ad.rx June Court Anno Domini 1695 of W.m Howes ag.t The said Plaintif obtained an Attachm.t ag.t the Defendant for Eighteen Joseph Letchworth pounds Eighteen shilling sterl money and attached the same in M.r Ignatius Craycrofts hands and now cause shewed to the Contrary it was by the Court condemned in the said Ignatius Craycrofts hands Recorded Octob 17.th 1696 a True Coppy p John Elsey Dept Clk To all Christian people to whome this present writing of Release shall Come I Robert Carvill of S.t Marys County gent send Greeting in our Lord God Everlasting Whereas the said Robert and Johannah his Wife did for the Consideracon of thirty thousand pounds of Tobbacco to the said Robert same well and truly paid by theire Indenture under theire hands and seales bearing date the six & twentith day of August 1684 bargaine sell and Convey to John Darnall Esq.r late of Calvert County decd a Certaine Tract or pcell of Land lying in the s.d County of Calvert called by the Name of Mellwood Parke containing by Estimacon one thousand fifty Acres or thereabouts And whereas the said Robert and Johannah upon the Ninth day of October following According to the Law of this Province in that Case made and Provided did acknowledge the same Indenture before two of his Lordp.s the Lord Proprietarys Councill and According to Law was upon the Fourth day of Aprill following Recorded in the Prov.ll Court but by mistake the Clerk that Writt the s.d Endorsment of the Acknowledgm.t afd made by the hath omitted to sett downe that the said acknowledgm.t was made by the s.d Robert as well as by the s.d Johannah his Wife whereby some scruples and Doubts have Arisen that the Law for Enrolement of Conveyances is not Fully Complyed with To prevent all which doubts and disputes for the future And as which as in me lyes to Corroborate the Right and Title of the sd John Darnall his heires and Assignes for Ever Know Yee that I the sd Rob.t Carvill doe for me and my heires Remise and Release and for ever quit Claime to the heires & assignes of the sd John Darnall all my Right Title Interest claime and Demand what soever which I the sd Robert my heires or Assignes or any Claiming by From or under me have or in any wise might have in or to the land Called Melwood Park or any pt or pcell thereof and the same Land and p.remises and every pt thereof ag.t me my heires Ex.rs or Adm.rs or any claiming by from or under me to him the s.d John Darnall his heires and assignes for ever will warrant and defend by these p.rsents As Wittness my hand and seale this eighth day of Octob 1695 Sealed and Deliverd Ro Carvile (seal) in presence of W.m Stone Charles Kilburne Robt Carss Recorded Octob 17.th 1696 H Wriothesley Clk |
