766 (749 therein Contained in the Provinciall Court of this Province and there Recorded according to Law and have in Ord.r for the Effecting the same given M.r Thomas Wickerley a Letter of Att.ry to acknowledge in open Court the same According to Law Wittness my hand and Seale this 28.th day of September Annoq Domini 1696 Wittness W.m Smoott (Seale) James Latimore Edw Potter his marke John I T Theobates October 3.d 1696 Memorandum by virtue of a Warrant of Attorney to M.r Thomas Whickerley this Conveyance was acknowledged by the sd Wickerley in open Court Christopher Gregory Clk Ass.tt Recorded October 17.th 1696 H Wriothesley Clk Maryland fs Know all men by these p.rsents that I Joseph Letchworth of Calvert County planter having for a Negroe A Malattoe and other Goods Amounting to the Sum of Eighty Eight pounds sterling Money of England in hand Received Assigned and made over to Philip Lynes of Charles County M.rchant for consideration of sattisfaction for the same one Obligacon of M.r Ignatius Craycrofts of Calvert County dated the 14.th day of May 1694 for sixty pounds sterling and three bills of exchange all of one Tenno.r & Date drawne by Thomas Tawney on Samuell Groome dated the 11.th day of June 1694 and payable after twenty days sight for twenty eight pounds of sterling Currant Money of England both sums makes y.e Eighty Eight pounds which is the sum of the value Recd of the said Lynes as afd and in case either the said Craycroft or the said Tawney or both of them or that Samuell Groome should not pay the said sums of Money afd for his the sd Lynes Recovery of the same or any pt thereof being not punctually paid according to the Tenno.r of the Obligation and bills of Exchange afd I doe hereby constitute & ordaine him the said Lynes to be my true and lawfull att.ry Irrevocable and to his the said Lyness owne proper use and Behoofe one or more att.rys give him hereto Constitute ordaine and in my Name appoynt for the more better Recovery of the said Debts or any of them to sue Implead & Imprison any of them for the same and out of Prison againe as he seek cause them againe to Release discharges in my Name herein Mentioned I hereby Ratefye and Confirme and Confirme by these p.rsents in as Ample Manner as if it were herein incerted holding and Ratifying all for Good that my said att.ry shall lawfully doe or cause to be done in the P.rmises as if I were there personally p.rsent as wittness my hand and seale this seventh day of September 1695 Wittness present Joseph Letchworth (seal) James Cox W.m Jones the mark of Martin N Discorah May 12.th 1696 Then came before me James Cox and Martin Discorah Wittnesses to this Obligation and made Oath upon the Holy Evangelist that they did see this Obligation sealed signed and Deliverd According to the Purport mentioned sworne before me Received Octob 17.th 1696 Rob.t Yates H Wriothesley Clk |
