750 (740 Soe many of the ways or means aforesaid or by any other ways or Meanes & in such manner and forme as by the said John Atkey his heirs or Assignes or any of them or his their or any of their Councill Learned in the Law shall be Reasonably devised advised and required And it is Lastly hereby Covenanted Granted Concluded Declared and fully agreed & Assented unto by and Beetween the partyes to these p.rsents and it is hereby declared to be that as well these presents as all and every further & other assurance & assurances of the afd parcell of Land Called Edmonsons Desire Which shall or May at any time or times hereafter be hade made done Acknowledged Executed and Sufferred by and between the said Parties to these p.rsents or any of them or any other person or persons by their or any of their directions Nominations or appointments shall be and enure and shall be adjudged Deemed Construed & taken to be & enure to and for the only proper use and behoofe of the said John Atkey his heirs and assignes for ever And to and for none other use Intent and purpose whatsoever In Wittness Whereof the parties first above named their hands hands & seales interchangably have sett and putt to these p.rsent Indentures even the day & yeare first above Written Annoq Dm 1696 Sealed & Delivered in the p.rsence of Will Dent (seale) James Elphinstone Memorandum on the back y.e sd Indenture was thus Indorsed viz John Thomas That the Lands & p.rmisses within menconed was before of their W.m Cooper Maj.ties Justices of the Provinciall Co.rt acknowledged by the sd W.m Dare to be the right of the within named John Atkey his heirs & Assignes for Ever & Desired the same might be Enrowled in their Maj.ties Provinviall Co.rt Court of Record In Testimony whereof I have here unto subscribed Allegiance the Tenth Day of June Annoq Dm 1696 Recorded June 10.th 1696 p Henry Wriothesley Clk M Wriothesley 18.th May 1696 Coll Harman has satisfied M.r Thomas Beale for the Judgm.t of sixteen thousand and sixty pounds of tobaccoe therefore pray Record this as satisfaccon upon Record for the same Judgment this is where I promised to doe at both their requests To M.r Henry Wriothesley Clk y.r friend & serv.t of the provinciall Court Tho Grunwin These And as to y.e other Judgment for two thousand Eight hundred pound of tobaccoe & seaven hundred and seaventeen pounds of tobaccoe Costs of suite the said Coll Harman paid the same being principally due to me which I desire alsoe to goe upon Record May 18.th 1696 Ro Carvile Recorded June 10.th 1696 p Henry Wriothesley Clk |
