738 (728 Prayed a Comission or Power might be given him for the seizing all wrecks thither Comeing & by Law Condemnable as alsoe to Looke after all wheales and other Royall Fish which at any time may happen to be druon & Casting therewith liberty of trying for Oyle What Can be got from the Clubber of the same Which being granted it is hereby provided that if the said Edward Green shall rend.r a just and true accot of all such wrecks drift Whales or other Royall Fish as either heretofore or for the future have or shall Come in to his possession Whereof an Advantage or bennifitt unto him the said Edward Green hath any time heretofore been made or henceforward shall be made unto his Maj.ties Court of Vice Admiralty on the Eastern Shore and pay shuch part thereof unto his Maj.ties Receiver Gen.ll without fraud or Covin as unto his Maj.ty by Law shall become due & unto the Vice Admirall What shall be his due then the above obligacon to be voyd otherwise to stand and Remaine in full force thousand six hundred Ninety & foure Between William Joseph of Calvert County Esq.r of the one part and Charles Carroll of S.t Marys County Gent of the other part Wittnesseth that the said William for and in Consideracon of the full sume of sixteen thousand pounds of tobaccoe to him in hand paid or secured to be paid the receipt whereof and every part and parcell thereof he doth hereby Acknowledge and thereof and Of Every part and parcell thereof Doth freely and Clearly Exonerate acquit & discharge him the said Charles by these p.rsents Hath granted bargained sould aliened enfeofed and Confirmed & by these p.rsents doth grant bargaine sell allien infeof and Confirme unto him the said Charles Carroll All that tract or parcell of Land Called the Forrest of Joseph lyeing in Dorchester County on the East side of Chesapeake Bay & on the West side of Nanticoake River in the Fresh Begining at two Marked Oakes standing by a Maine Branch of y.e said River about two miles from Christopher Unttos plantacon and runing Downe the said branch south west and b y south three hundred and twenty p.rches thence south east eight hundred p.rches to an other maine branch of the said River thence with the said Branch North East and by North three hundred and twenty p.rches thence with a straight line to the first bounder Containeing and Now laid out for fifteen hundred Acres More or Less according to the Certificate of survey thereof taken & returned into y.e Land office of this Province at the Citty of S.t Marys beareing Date the twentieth Day of Aprill One thous.d six hundred Eight and Nine and there Remaineing upon Record Which said Tract or p.rcell of Land was afterwards that is to say upon the sixth Day of June in the said Last recited yeare pattened und.r the greate seale of this province unto him the said W.m Joseph Together with all Woods underwoods Marshes swamps Rights profits benefits priveleges advantages and appurtenances Whatsoever to the same belonging or in any waise appertaineing in as Large & Ample Manner as the same is held by the said W.m Joseph from the Right hon.ble Charles Lord Baron of Baltemore & Proprietary of this province & und.r y.e same & Noe other rents nor services Whatsoever To have and to hold y.e said Tract or p.rcell of Land with all and singular the p.rmisses & appurtenances Whatsoever to y.e same Belonging or in any Wise appertaineing Granted or Intended by these p.rsents to be Granted and Conveyed unto the said Charles Carroll & his heirs for Ever to the only proper use and behoofe of him the said Charles & his heirs and to Noe other use intent or purpose whatsoever And the said W.m Joseph for himselfe his heirs Ex.rs & Adm.rs doth by these p.rsents Covenant & Grant to and with the said Charles Carroll his heirs Ex.rs & Adm.rs that he y.e said William his heirs Executo.rs & Adm.rs shall and will from time and att all times hereafter acquit discharge and save harmless as well the said Tract of Land and P.rmisses with all and singular their appurtenances and every part and parcell thereof as alsoe the said Charles Carroll his heirs Ex.rs and Adm.rs of and from all Manner of former bargaine seales promisses Joyntures Dowers Condicons & all other littles Charges and Incumbrances Whatsoever had Knowledge done or Caused or Made by the said W.m or by his Assent Consent or procurement at any time or times (the Rents and services thereof due unto the R.t Hon.ble the Lord Proprietary of this province of that shall hereafter grow due unto him onely excepted and foreprised And that y.e s.d W.m Joseph & his heirs shall and will Warrent & defend unto the said Charles Carroll and his heirs the said Tract of Land and p.rmisses with all and singular the Rights Members & appurtenances & every part and parcell thereof without any lawfull suite eviction devesting or disturbance of the said W.m Joseph or his heirs or of any other p.rson or persons Whatsoever Claimeing by from or und.r him them or any of them In Wittness Whereof the said W.m Joseph hath hereunto set his hand & affixed his seale the day and yeare first above Written Sealed and Delivered in the p.rsence of us May y.e 17.th 1695 W.m
