713) 723 The Condition of the above Written Obligation is such that Whereas his Ex.ncy Francis Nicholson Esq.r hath Comissionated & appointed the said Philip Clarke to be Navall Officer from Point Lookout to Port Tobacco in the River of Potomock in the said Province of Maryland by his Comission bearing Equall Date With these presents Now if the said Philip Clarke shall well and truly perform the said Office according to the severall Acts of Parliam.t in that Case made and provided And shall observe the Directions Contained in the Acts of Assembly of this Province Relateing to the Duty of Navall Officers & from time to time save defend and keep harmless the said Francis Nicholson Esq.r from all Damage Loss and Charges that he the said Francis Nicholson Esq.r shall sustaine at any time by Reason of the said Philip Clarkes non performance of his Office (so long as he shall Enjoy the same) as in the said Severall Laws is Enacted and Ordained Then the above Obligacon to bee void and off none Effect otherwise to bee and Remaine in full force and Vertue Sealed Signed & Delivered Philip Clarke (seale) in the Presence of Us Thomas Tench Rob.t Mason (seale) Ed Randolph Know all men by these presents that Wee S.r Thomas Laurence Baron.t & Principall Secretary of Maryland and Rob.t Mason of Sn.t Maries County Gentl are holden and firmly bound unto his Ex.ncy Francis Nicholson Esq.r Cap.t Gen.ll and Govern.r in Cheif of this their Ma.ts Province of Maryland in the full sume of Five hundred pounds good and Lawfull Money of England To be paid to the said Francis Nicholson his heirs or successo.rs Govern.rs of Maryland To the which paym.t Well and truly to be made Wee bind ourselves our heires Ex.rs & Adm.rs Joyntly & severally for & in the Whole firmly by these p.rsents sealed with our seales and dated this day of November Anno Dom 1694 The Condicon of this Obligacon is such that Whereas the above menconed Fra Nicholson Esq.r Govern.r of Maryland as afd hath this day granted unto the above bound S.r Thomas Laurence a pmitt to transport himselfe out of this Province with directions to all Masters of Ships or other Vessells that the May safely Transport the said S.r Thomas Laurence as afd In as much as his said Ex.ncy Fra Nicholson Esq.r had taken sufficient caution & security for the paym.ts of such Debts (if any) as the s.d S.r Thomas Laurence doth owe in this Province According to the Act of Assembly of this Province If therefore the s.d S.r Thomas Laurence and Robert Mason or either of them their Heires or Assigns shall in all respects Indempnifye his said Ex.ncy Francis Nicholson Esq.r for his granting the said Pmitt or Lycense to the said S.r Thomas Laurence according to the Tennor of the said Act of Assembly that then this Obligacon shall be Void or Else to stand in full force and vertue in Law Sealed and Dd in p.rsents of Thomas Laurence (seal) Ed Randolph Rob.t Mason (seal) Will.m Dent |
