660 (650 This Indenture Made the fourth day of Septemb.r in the 4.th yeare of the Reign of our Soveraigne Lord and Lady W.m and Mary by the grace of God King and Queen of England Scotland France and Ireland defend.rs of the faith &c & in the yeare of our Lord God one Thousand six hundred Ninety and two between Lionell Copley of the Province of Maryland Esq.r of the one part and Edw.d Chilton of the County of Charles City in the Colony of Virg.a gent of the other part Wittnesseth that the said Lionel Copley aswel for and in Consideracon of the full and just sume of three hundred pounds sterl Money of England to him in hand paid by the said Edw.d Chilton before the ensealing and delivery of these presents as alsoe for divers other goods Causes and Consideracons and by these p.rsents doth lyne grant bargaine alien enfeoffe and Confirme unto the said Edw.d Chilton y.e tract or parcell of land Commonly called or known by the Name of Bollon Lying on the East side of Chesepeak Bay on the north side of a River in the afd bay Called Elk River the land Called Turkey Point begining at a Marked Oake by a Marsh side neer a long sandy point runing for breath down the river two hundred and Ninety perches and by the bay side two hundred pches bounding on the East by a line drawne North & by East from the aforesaid Oake for length three hundred and twenty pches on the North by a line drawn West South West from the End of the North line into the said bay on the West side with the said bay on the south with the said River Conteyning & laid out for one thousand acres of land more or lesse togeather w.th all Pattents Escripts Writeings Minum.ts & papars and all & singular the rent profitts privillidges Members & appurtenances thereunto belonging or in any waies appartaineing to have and to hould the said tract or parcell of land to him the said Edw.d Chilton his haires and assignes for ever w.th warranty of and ag.t all parsons Whatsoever Claimeing by from or und.r him the said Lionel Copley his heires & assignes or any of them & the said L Copley for himselfe his heires and assignes doth hereby Covenant grant and agree to and with the said Edward Chilton his heires and Assignes by these presents that he the said L Copley at the time of Ensealing & delivery of these psents hath good Right full power and lawfull Authority to grant sell alien enfeoff & Confirme unto the said Edward Chilton his heires & Assignes for Ever the abovesaid land & premisses in Mannor aforesaid & then he the said Edw.d Chilton his heires and Assignes shall & may have hould use occupy posses and enjoy the aforesaid parcell of land & p.rmisses with all & singular the appurtenances without any let suit trouble eviction Molestation or interruption of him the said L Copley his heires Ex.rs or assignes or either of them provided alwais & und.r Condicon that if the said Lionel Copley his heires Ex.rs Adm.rs or Assignes shall well & truely pay or cause to be paid unto the said Edw.d Chilton his Ex.rs Adm.rs or Assignes the aforesaid sume of three hundred pounds Sterl Money of England in Manner & forme following that is to say five pounds part thereof at or upon the ensealeing & delivery hereof one hundred & twenty pounds More thereof in or before the five & twentieth day of Aprill next Ensueing the date hereof one hundred & twenty five pounds More on or before the five & twentieth day of Aprill w.ch shall be in the yeare of our Lord one thousand Six hundred Ninety & foure and the remaineing fifty pounds on or before the five & twentieth day of Aprill w.ch shall bee in the yeare of our Lord one thousand six hundred Ninety & five without fraud Covin or delay the sd three last Mentioned payments to be Made by good and sufficient bills of Exchange to be delivered by y.e said Lionel Copley to the said Edw.d Chilton or his assignes at or before the respective dayes & years afd then & from thence fourth it shall & may be lawfull to & for the said Lionel Copley his heires and Assignes into the said Land & p.rmisses to want or & have again reposses occupy & enjoy as in his & their first or formar Estate & that then ^and^ in such case the same shall be & enure to y.e p yearly ^onely^ proper use & behoofe of the said L Copley his heires & assignes for ever & these presents and the hand & seale of the said L Copley shall be delivered up to him or his assignes to be Compelled & made void any thing here in conteined to the contrary thereof in any wise Notwithstanding & the said L Copley doth for himselfe his heires Ex.rs & Adm.rs covenant grant promise & agree to & w.th the said E Chilton his heires & assignes by these psents in Mannor & forme following that is to say that he the said L Copley his heires Ex.rs & Adm.rs shall & will well & truely pay or cause to be paid unto the said E Chilton his Ex.rs Adm.rs & Assignes the afd sume of three hundred pounds sterl in Mann.r ^and forme^ aforesaid without fraud covin or delay or otherwise if default shall happen to be made of or in paym.t afd of the afd sume or any part or parcell thereof proportionably on the dayes & tymes & in Manner & form as is herein before Expressed |
