642 (632 This Indenture made the second Day of May and in the fourth yeare of the Reigne of our Sovereigne Lord and Lady William and Mary King and Queene of England Scotland France and Ireland defenders of the faith &c Between Daniell Moy of S.t Maryes County sonne and heir of Richard Moy of the same County deceased on the one part and Thomas Price Senior of the same County of S.t Maryes Carpender on the other part Witnesseth that for and in Consideracon of the sume of four thousand five hundred pounds of tobacco to him the said Daniell in hand paid and before the ensealing hereof by the said Thomas Price the Receipt whereof the said Daniell doth hereby acknowledg and himselfe thearof and therewith fully satisfied Contented and paid thereof and of every part and parcell thereof doth Clearly Aquitt Exoneratt and discharge the said Thomas Price his heires Executors Administrat.rs and Assignes and every of them by these p.rsents Hee the said Daniell Moy hath demised Granted set and to farm Lett and by these presents doth demiss grant sett and to farm Lett unto the said Thomas Price all that Parcell of Land situating and beeing in S.t Maryes County binding upon A spanish Oake standing upon the branch by the fresh of hunting Creeke and Runing South and be East binding upon Walter Taylers Land Daniell Moys Land Edward Fishers Land and upon A parcell of Land Called Whitwell Containing and Laid out for sixty Acres bee the same more or Less for and dureing the full & just terme of one thousand yeares next ensueing the day of the Date hereof yealding and Paying therefor yearely during the said tearm of yeares unto the said Daniell Moy his heires Executo.rs Adm.rs or Assignes on the one of the feast of the Nativitie of our Lord God one shilling starling Money and the said Thomas Price his heires Executo.rs Administrato.rs and Assignes Shall and will dureing the said terme of yeares leave unto the said Daniel Moy his heires Ex.rs Adm.rs and Assignes A good and sufficient outlet into the woods through the said Land without ever A falling Grace to Have and to hould the said Sixty Acres with all its Ways Easm.ts profitts privilidges Enrowlments and Appurtenances to the said p.rmisses belonging or in any manner of ways Appartaining during the said tearm of yeares and the said Daniel Moy for himselfe his heires Executors Administrators and Assignes and for every of them doth hereby Grant Covenant Grant and Agree to and with the said Thomas Price his heires Execut.rs Administrato.rs and Assignes by these p.rsents that the said Daniell Moy at the time of the signing sealing and delivery hereof is the trew and Lawfull Owner of the p.rmises and is seased of the same in a good suer parfect and indefeasable Estate of Inheritance in fee simple to him and his heires without any Limitation or other Matter to Alien or Chang the same and that hee the said Daniell Moy in himselfe hath full Power and Abosolute Authority to grant and demise the same in manner and form aforesaid and that the said Thomas Price his heires Executo.rs Administrato.rs and Assignes shall and may During the said term of one Thousand yeares heareby leased set and to farme Lett and every of them have hould use Occupia peacably and Quiatly Posese and Enjoy the said sixtie Acres of Land and its Appurtenances without any Let suit troble Molastation eviction or disturbance of or by the said Daniell Moy his heires of Assignes or any Claiming by from or under him them or Any of them or of of or by any |
