616 (606 This Indenture made the Nineteenth day of October Anno Domini 1688 and in the 4.th yeare of the Reign of our soveraign Lord James the Second by the grace of God of England Scotland France & Ireland King Defend.r of the Faith &c.a Betweene Penelope Cornwallis Widow Relict and sole Executrix of the last Will and Testament of Thomas Cornwallis late of Burnham thorpe in the County of Norfolke Esq.r deceased of the one part and Edward Pye of Charles County in the Province of Maryland Esq.r of the other part Witnesseth That the said Penolope Cornwallis for and in Consideration of the sume of five shillings of Lawfull money of England to her in hand paid before the ensealing hereof by (the sd Edward Pye) the receipt whereof is hereby acknowledge accordingly Hath bargained sold and Demised and by these p.rsents Doth bargaine sell and Demise unto the sd Edward Pye All That Tract of Land lying on the east side of Piscataway River scituate Lying and being in the sd Province of Maryland in the parts beyond the seas called by the name of Mattawoman Neck or by whatsoever other Name or Names the same is or heretofore hath beene called or knowne Begining at a M.rked Ash tree in a swampe in or Neare a Indian Towne Running for bredth into the woods nine hundred & sixty p.rches on the East by a Southeast line thereon the south with a line drawne West from the end of the sd southeast line in a Fresh Runn of a great Creeke called S.t Thomas Creeke and with the sd Fresh Runn and Creeke on the West with the River for the length of one hundred & Fifty p.rches on the North with the River for the Length of one Thousand six hundred p.rches conteyning and Laid out for Five Thousand acres More or lesse all which p.rmisses are now in the possession of the Indians And allso all the Estate Right Title Interest claime & Demand of her the sd Penolope Cornwallis of in or to the p.rmisses or any part thereof To have and To hold the sd Tract of Land and all and singular other the p.rmisses & every of their appurtenances unto the said Edward Pye his Ex.rs Adm.rs and Assignes from the day before the day of the date hereof unto the end & Terme of one whole yeare from thence next ensuweing and fully to be compleate and ended Yeilding and paying therefore the rent of one pepper corne at the feast of the Nativity of S.t John Baptiste next ensueing (iff the same be Lawfully demanded) To the intent that by vertue of these p.rsents and of the statute for transfferring uses into possession The said Edward Pye May be in the actuall possession of the p.rmisses and thereby enabled to accept a grant of the reversion and Inheritance thereof To him & his heires to uses to be thereof Declared In Witness whereof the parties afsd to thes Indentures Interchangeably have put their hands & seales the day and yeare first above written Sealed & Delivered Penelope Cornwallis (sealed) in the p.rsence of Tho Hasted Will.m Burnham Jn.o Harris Gust Scory Not Pub Int.r 10.th March 1692 |
