596 (586 William & Mary by the grace of God King & Queen of England Scotland France and Ireland Defenders of the Faith &c.a To all sherriffs Bailiffs and others to whom these presents shall come Greeting in our Lord God Everlasting Because Wee have understood by the Reccord of our Provinciall Court of our Province of Maryland that John Ouldston of Baltemore County in our said Province Taylor Convicted and deteyned in the prison of S.t Maries County for the Death of Dennis Garrett of which he was indicted killed the said Dennis Garrett by chance and not by Felonÿ or of Malice forethought Wee Moved with pitty and Compassion have & doe by Vertue of these p.rsents Pardon and remitt unto the said John Ouldston the said Manslaughter and granted unto him our firme peace thereupon soe that notwithstanding the said Manslaughter he stand in our Courts if any one will him thereupon implead Given under our great seale of our said Province of Maryland Witness our trust and Well beloved Lionel Copley Esq.r our Cap.t Gennerall and Govern.r in Cheife in and over our Province and Territory of Maryland afsd this Twentyeth day of Aprill in the 4.th yeare of our Reigne &c.a Annoq.r Domini 1692 This Indenture made the 23.d day of Decemb.r in the 4.th yeare of the Reign of our Soveraign Lord & Lady William & Mary by the grace of God of England Scotland France & Ireland King & Queen Defend.rs of the Faith &c and in the yeare of our Lord Christ 1692 Between Lionell Copley Esq.r Cap.t Gen.ll Cheif Governo.r & Vice Admirall of the Province of Maryland &c of the one part and Robert Grundy of Talbott County Mariner of the other part Whereas the sherriffe of Talbott County by vertue of a certaine precept from the Court of Admiralty of this Province to him directed bearing date the 12.th day of October Anno Domini 1692 And thereby comanding & requiring him to expose & putt to seale the shipp called the Ann of Newcastle Now at Anchor in Greate Choptanck River with her boates and all her gunns riggins Tackle apparell Amunition and Fourfiture she being by due course and tryall at law at a Court of Admirality Convicted and Condemned for payment of the sailers wages Now This Indenture Witnesseth that the sd Lionell Copley by Vertue of the Decree & precept afsd for and in consideration of the Sume of four hundred thirty one pounds one shillings & six pence sterling good & Lawfull mony of England to him in hand paid or otherwise well & sufficiently secured to be paid before the ensealing & Delivery of these p.rsents the receipt whereof and every part thereof the sd Lionell doth hereby acknowledge and confess and himselfe to be therewith fully contented satisfyed & payd and thereof and every part thereof doth hereby release acquitt exonerate & discharge the sd Robert Grundy his heires Ex.rs Adm.rs and every of them for ever by these p.rsents hath given Granted bargained and sold and by these p.rsents doth fully clearely and absolutely Give Grant bargaine sell & confirme unto him the sd Robert Grundy his heires & Assignes all all that the vessell or good shipp called the Ann of Newcastle Now at anchor in Choptanck River and all the boates and other vessells to the sd shipp Belonging or in any wise appurteyning and all her gunns Tackle apparell riggins and Furniture the p.rticulars whereof appeareath by a certaine schedule or Inventory to these p.rsents annexed To have & to hold the sd shipp called the Ann of Newcastle with all her boates & other vessells and all and singular her Gunns Tackle Rigging aparell amunition and Furniture in the sd schedule conteyned & specifyed to him the said Robert Grundy his heires & assignes for ever In Testimony |
