572 (562 Pattison now are and stand or some or one of them now is or are and stand or standeth rightfully and indefeizably seized of & in the said land & premisses hereby bargained & sold or ment or intended to be bargained & sold with the appurtennces of a good sure perfect lawfull & absolute Estate of inheritance in fee simple without any manner of Restraint matter or thing to alter change charge determine or make voyd the same And that they or some or one of them have good right full power & absolute authority to grannt & convey the sd bargained premisses to the said Edward Greenhalgh his heires & assignes for ever in manner & forme aforesaid And also the said plantacon & premisses (except before excepted now are & be & soe from henceforth shall be remaine continue & endure unto the said Edward Greenhalgh his heires & assignes Free & cleare & freely & clearly acquitted exonerated & discharged or otherwise well & sufficiently saved kept harmles & indempnified by the sd Garret & Zacharias Vansweringen their heires & assignes of & from all & all manner of former & other guifts grannts bargaines sales leases mortgages joyntures dowers & titles of dower uses wills entailes titles troubles charges & encumbrances whatsoever (The yearely quit rent due for the premisses from henceforth onely excepted) And further that the said Edward Greenhalgh & his heires & assignes shall & may from time to time and at all times hereafter peaceably & quietly have hold occupy possesse & enjoy the aforesaid land plantacon & premisses without the lawfull let suite trouble interrupcon or disturbance of the sd James Pattison Garret Vsweringen & Zacharias Vsweringen or any clayming under them or any of them or by from or under the said Walter Hall decd or by from or under any other persons whatsoever And moreover that they the said Garret Vsweringen Zacharias Vsweringen and James Pattison and all other persons any estate haveing or lawfully clayming of into or out of the said land and premisses hereby intended to be conveyed shall and will at all times hereafter upon the reasonable request and at the costs & charges in the law of the said Edward Greenhalgh his heires or assignes Doe make acknowledge levy suffer & execute or procure to be done made suffered levyed and executed all and every such further and other lawfull & reasonable act & acts conveyances and assureances in the law whatsoever for the further and better conveying and assureing the said tract of land plantacon and premisses (except before excepted) unto the said Edward Greenhalgh and his heires to the use of the said Edward & of his heires and assignes for ever Be it by fine Recovery deed or deeds or by any other lawfull & reasonable wayes or meanes whatsoever As by Councell learned in the law of the said Edward Greenhalgh his heires or assignes shall be reasonably devised advised and required And soe as the persons required to make such further assureance be not required for the doeing or makeing thereof to travell further then the City of S.t Maries or at the furthest above Twenty miles from the place of their then present habitacon All which further assureances shall be & inure and shall be deemed adjudged construed & taken to be & inure To the onely proper use & behoofe of the said Edward Greenhalgh his heires & assignes for ever and to & for none other none use intent or purpose whatsoever In witnes whereof the parties aforesaid to these Indentures interchangeably save put their hands & seales the day & yeare first above written G Vsweringen Zacharias Vanswearingen James Pattison Sealed & delivered by all the within bargainors And then it was declared that the Quit rent for the six hundred & fifty acres within sold & to be from henceforth payd to the said James Pattison & his heires is and is hereby declared to be Thirteene shillings sterling p Anum In the presence of Philip Clarke Tho Grunwin M.d This Fifth day of March 1691 Came the within named Garret Vsweringen Zacharias Vsweringen & James Pattison and severally acknowledged the within deed to be their severall Acts before us underwritten Two of his Ma.ties Justices of the County Court of S.t Maries County as witnes our hands Rob.t Mason Jo Watson Recorded the Twelfth day of Aprill 1692 |
