54 on the back side of the Aforegoing letter of Attorney was thus written February 19.th 1677 The within written letter of Attorney was then in open Court proved by the oath of Anthony Evans to be the Act and deed of the within menconed George Smith Nic Painter Cl Cur provinc Att a Speciall Court of Oyer & terminer held att the Citty of S.t Maryes the Eighteenth day of March in the Third yeare of the Dominion of the right Hon.rble Charles Lord Baron of Baltemore Absolute Lord & Prop.ry of this Province &ca Annoque Domini one thousand six hundred seaventy seaven before his Lorpps Justices thereunto assigned for the hearing and determining of all breaches of any act or Acts of Parliament relateing to Navigacon or trade by whomesoever or whensoever done perpetrated or Comitted within this Province att which sayd day were present Robert Carvile Walter Hall gentlemen Justices Garret Van Sweringen The Court being called the Comiss.rs did Comand the Comission by vertue of which they Sate to be read by the Clerke which was accordingly done and followeth in these words viz.t Charles Absolute Lord & Prop.ry of the Provinces of Maryland & Avalon Lord Baron of Baltemore &ca To our welbeloved Robert Carvile Walter Hall John Darnall & Garret Van Sweringen Gentlemen Granting Know yee that wee have assigned you or any Three or more of you (of whome we will the said Robert Carvile to be one) our Justices to Inquire by the Oathes of such and soe many good and Lawfull men of this our Province and by such other wayes and meanes by which the truth of the matter may more plainly appeare and to you shall same best of all breaches of any Act or Acts of Parliam.t relateing to Navigacon or trade by whomsoever and whensoever done perpetrated or Comitted within our said Province when how and in what mann.r and of all other Articles and Circumstances of the Premisses or any of them any manner of way touching or Concerning and the same for this tyme to hear & determin according to the laws and Customes of the Kingdom of England and of this our Province And therefore we Comand you that on the Eighteenth day of this Instant moneth of March att the Court house att the Citty of S.t Maryes you or any Three or more of you (of whom we will the said Rob.t Carvile to be one) make diligent Inquirey of and upon the Premisses and the same heare Determine doe and performe in manner aforesaid doeing therein what to Justice apperteineth according to the laws and Customes of the Kingdom of England and of this our Province saveing to us our forfeitures and amerciam.ts And other things from thence to us ariseing or belonging And we have Comanded our sherriff of our County of S.t Maryes or his Deputy that att the day and place aforesaid he cause to come before you or any Three or more of you (of whom we will the said Robert Carvile to be one) twelve good and lawfull men of his Bailiwick as well within libertyes as without by whom the truth of the matter in the Premisses may be the better knowne and enquired of And that he or his Deputy be then and there to doe and performe those things which to his office appertaine to be done And we have alsoe assigned Nicholas Painter Clerke for the keeping and fileing the Informacon Records and miniments to the Premisses apperteyning And them & every of them to bring before you or any Three or more of you (of whom we will the said Robert Carvile to be one) And the same And your proceedings therein to Register & Record according to law & the Customes of this our Province In testimony whereof we have Causes these our letters to be made Patents Wittnes our selfe att our Citty of S.t Maryes the fourteenth day of March in the Third yeare of our Dominion &.ca Annoq Domi one Thousand six hundred seventy seven Thomas Notley which said Comission being Read Christopher Rousby Esq.r his mag.tie Collector in this Province presents an Informacon to this Court which follows in these words viz.t Maryland fs Bee it Remembred that Christopher Rousby Collector of all the rates dutyes and Impositions due and Payable to his ma.tie in Maryland who as well for our Soveraigne Lord Charles the second King of England Scotland France & Ireland Defender of the faith &.ca & The Honn.ble Thomas Notley Esq.r Chiefe Governour of the said Province of Maryland as for himselfe in this behalfe followeth came here in Court the Eighteenth day of March in the yeare of our Lord one thousand six hundred seventy seven in his Propper person and as well for the said Lord the King and for the said Governour as for himselfe Exhibited to the Justices of a certain Court here held by speciall Com.rs & Delegates thereunto by Comission from the Right |
