534 (524 Edward & Dudley Carleton Which Report being read and heard and very well understood by the Court here and both Plaintiffe and Def.t being alsoe ag.t Present and declaring that they were both very well Contented and sattisfied in the whole Report of the Auditors aforesaid Richard Marsham Jn.o Hance & Whereupon it is this day (to witt) y.e Nineteenth Day of Jan.ry in the xiiij.th Year of the Dominion of the R.t hon.ble Charles &c Annoq Sarah Warren Ex.rs of Baz.ll Warren Domini 1688 Considered by the Court here That the said Edward Carleton and Dudley Carleton Recover ag.t Richard Marsham John Hance and Sarah Warren Exec.rs of Bazell Warren dec.d all the Goods and Merchandizes as is above mentioned in the Invoice amounting to Eighty Nine Pounds seaventeen shillings and three Pence half penny Sterling Money and all the Tobacco as appears by a List of hh.ds received of severall Persons and marked for the account of the said Edward Carleton and Dudley Carleton being in all forty one hh.ds conteining Nett seaventeen Thous.d one hundred seaventy and three Pounds of Tobacco And alsoe all the bills and Acco.tts due from the severall Persons mentioned in the List of Debts due to the said Edward and Dudley Carleton amounting in the whole to the sum of one hundred sixty seaven Thousand seaventy and seaven p.ds of Tobacco and the said Defend.t in Mercy &c And it is further Considered by the Court here That the said Edward Carleton and Dudley Carleton have no Cost of Suite ag.t the said Richard Marsham John Hance and Sarah Warren Exec.rs of Bazell Warren dec.d by Reason it has been made appear to this Court here that the said Richard Marsham John Hance and Sarah Warren Exec.rs of ^s.d^ Bazell Warren were alwais ready and willing to Render and give an Acco.tt of all Concernes relateing or belonging to the said Edward and Dudley Carleton from the said Bazell Warren as by the affidavits of Thomas Greenfield Francis Buxton & John Taney Relacon being thereunto had aforesaid doth more plainly and at large appear R Tull Cler Cur Maryland sc Whereas at a Court of Oyer and Terminer held at the City of S.t Maries the Nineteenth day of Jan.ry in the xiiij.th Year of the Dominion of the R.t hon.ble Charles &c Annoq Domini 1688 Edward Carleton and Dudley Carleton of London Merch.ts Recovered ag.t Richard Marsham John Hance and Sarah Warren Exec.rs of Bazell Warren late of Calvert County dec.d sundry Goods and Merchandizes Tobacco bills and Acco.tts belonging to the said Edward and Dudley Carletons of London Merch.ts aforesaid liveing and Resideing in Maryland aforesaid as by a Judgement remaining upon Record in the Sec.rys office of this Province (Relacon being thereunto had) more fully doth and may appear All w.ch said Goods Merchandizes Tobaccoes Bills and Accompts I Thomas Davies Atturney of the said Edward Carleton and Dudley Carleton doe by these Presents acknowledged to have rec.d and thereof and every part & Parcell thereof and all other Concernes whatsoever between the said Edward Carleton and Dudley Carleton aforesaid and the said Bazell Warren dec.d for ever discharge Release and Acquitt the said Richard Marsham John Hance and Sarah Waring Exec.rs of the said Bazell Waring their Heirs Exec.rs and Adm.rs and of and from all and all manner of Actions and Suites Cause and Causes of Actions and Suites Bills Bonds Wrighteings and Accompts Debts sums and Quantities of Tobaccos Controversies Judgements and Demands whatsoever And from all future Claime and Demand of either of the said Edward Carleton and Dudley Carleton their or either of their Heirs Exec.rs adm.rs or assignes for or by Reason of any Matter Cause or thing whatsoever from the beginning of the world to the Day of the Date hereof As wittness my hand and seale this Twenty sixth day of Jan.ry Annoq Domini one Thousand six hundred Eighty and Eight signed sealed and Delivered Tho Davis (sealed) in the presence of us Tho Brooke Jan.ry y.e 26.th 1688 Tho Greenfield Then the above written Release was proved Luke Gardiner Before me Henry Darnall Recor p R Tull Clk This Indenture made the Fifteenth Day of November in the year of Our Lord God One Thousand six hundred Eighty & Eight and in the Thirteenth year of the Dominion of the Right Honourable Charles Absolute Lord and Prop.ry of the Provinces of Maryland Avalon Lord Baron of Baltemore &c And made between Elias Nutthall & Elizabeth his wife their Heires Executors Administrators of the one pt and Richard Ridgell of Calvert County his Heires & Assignes of the other pt Wittnesseth that the said Elias & Elizabeth his wife for and in Consideracon of the sume of six Thousand Pounds of Tobacco to them in hand paid by the said Richard Ridgell att and before the sealing and delivery hereof the Receipt whereof they doe hereby acknowledge & themselves therewith & of every part & pcell therof fully sattisfied Contented and paid And doe by these Presents Exonerate Acquitt and discharge the said Richard Ridgell his Heires Executors Administrators & every of them by these Presents for Ever And for divers good Causes and Considerations them the said |
