523) 533 January the 17.th 1688 A List of hoggsheads of Tobacco Received by Bazill Waren Late Deceased & his Order for the use of Edward and Dudley Carleton of London Merchants weighing Marked & N.o as followeth (Viz.t)
Richard Smith Jun.r Michaell Taney George Lingan Which Report being read and heard and by the Court here very well understood and both Plantiffe and Defendant being alsoe present in Court and declareing they were both very well Contented and sattisfied in the whole Report of the Auditors aforesaid Whereupon it is this day (to witt) the Nineteenth day of Jan.ry in the xiiij.th Year of the Dominion of the R.t hon.ble Charles &c annoq Domini 1688 Considered by the Court here that the said Edward Carleton and Dudley Carleton Recover ag.t Richard Marsham John Hance and Sarah Warren Exec.rs of Bazell Warren dec.d all the goods and Merchandizes as is above mentioned in the Invoice amounting to Eighty Nine Pounds seaventeen shillings & thee Pence half penny ster money and all the Tobacco as appears by a List of hogsheads rec.d of severall Persons and Marked for acco.tt of the said Edward Carleton and Dudley Carleton being in all forty one hh.ds q.t Nett seaventeen Thousand one hundred seaventy and three p.ds of Tobacco and alsoe all the bills and accounts due from the several Persons mentioned in the List of Debts due to the said Edward Carleton and Dudley Carleton amounting in the whole to the sum of one hundred sixty seaven thousand seaventy and seaven p.ds of Tobacco And the s.d Defendants in Merch &c And it is further Considered by the Court here that the said Edward Carleton and Dudley Carleton have no Cost of suite ag.t the said Richard Marsham John Hance and Sarah Warren Exec.rs of Bazell Warren dec.d by Reason it has been made appear to this Court here that the said Richard Marsham John Hance and Sarah Warren Exec.rs of the said Bazell Warren were alwais Ready and willing to Render and give an acco.tt of all Concernes relateing or belonging to the said Edward Carleton and Dudley Carleton from the said Bazell Warren as by the affidavitt of Thomas Greenfield Francis Buxton and John Taney relacon thereunto being had aforesaid doth more plainly and at large appear And it is alsoe Ordered by the Court here that Richard Tull the Clarke of this Court have allowed him the sum of two thousand and one hundred pounds of Tobacco for sattisfaction of his Charge and Attendance upon this speciall Court |
