463) 473 the morning & once in the afternoone goe up and downe and search the severall ordinaryes within this said Citty present and Testifie liberties thereof to see what rules and orders are kept and shall att every Mayors Court held for the said Citty present and Testifie upon oath what will rule and orders (are kept) in any other or all of the said ordinary on Sundays or sabboth dayes aforesaid Item It is further Ordeyned Established and enacted as aforesaid that if any the Ordinary Keepers within this Citty or libertys thereof presume to sell any manner of liquors whatsoever by any other measure than what shall be proportionable to the Measure that are already stamped and allotted as a standard for the said Citty and w.ch is in the Custody of M.r John Baker that hee she or they presumeing soe to doe shall be deemed to sell liquors by false Measures and is guilty of the breach of the Act of Assembly relateing to Ordinary Keepers and this Court will take advantage against them as is Mentioned in the same Act Item It is further Enacted Ordeyned & Established that Noe person or persons whatsoever presume to Keep ordinary within the said Citty of S.t Marys or libertys thereof without Lycense from this Court first had and obtained Any person soe presumeing as aforesaid shall be deemed an Ordinary Keeper without Lycense and comes under the penaltys of the Act of Assembly in that case made and provided Item Whereas Complaint hath been made to this Court by severall inhabitants of the said Citty of the very great damage and mischeifes that are done by hoggs kept within the said Citty or libertys thereof or places neer adjacent thereto by killing the poultry rooteing up the gardens and feilds & otherwise It is therefore Enacted ordeyned and Established that noe person whatsoever inhabiting whithin the old feild of this Citty shall for the future caise or Keepe any hoggs piggs sowes or barrowes without they be kept in a good & sifficient hogg penn And that if the Constable doe at any time after the Tenth day of November next ensueing doe or shall find any manner of hoggs to come or feed or be within the Citty not being in such sufficient hoggs penns as aforesaid contrary to the true intent hereof that hee doe cause the said hoggs to be pounded and kept in such place or pound he shall thinke fitt to secure them Where the said hoggs shall remaine till the owner doe pay to the said Constable six pence or peece for the pounding such hoggs piggs or shoate or other hoggs whatsoever Item It is further Enacted ordeyned and Established that from henceforth forward the Constable of the said Citty for the time being doe and shall every yeare in the Month of August take a List of all and singular the Inhabitants taxable persons within the said City and make a returne |
