472 (462 Every month be and is hereby appoynted for Court dayes whereon the said Court is duely from henceforth to be held On w.ch said last Saturday of every month by Tenn of clock in the fore noone of the same day the said Mayo.r Recorder Aldermen & Comon Councillmen of this Citty are to be and personally appeare at the said Citty of S.t Marys to hold Court as aforesaid And every such member or members of this Court as shall not be then and there p.rsent as aforesaid & haveing noe cause (lawfull & acceptable to the Court) to shew for such his or their absence shall be fined at the discretion of the Court then sitting or the Major part of them w.ch Fine or Fines shall be recovered by way of Execucon upon the body goods or Chattles of such offender Whereas this Court takeing into their serious Consideration the greate charge & expences the Clerke thereof is putt to in attending Courts and finding books for records And alsoe Considering the meane proffitt and advantage that accrue to him for officiating in the said office Item It was and is hereby Enacted ordeyned & established that the Clerke now officiateing shall ^have^ and be allowed and payd him not onely one Fourth or quarter part of all Fine & Fines that have beene by the said Court at any time or times heretofore imposed upon any person or persons whatsoever but alsoe shall be allowed and payd him out of all other Fine or Fines that shall or may att any time or times hereafter be imposed upon any person or persons whatsoever One full fourth or quarter part thereof To be levyed & recovered by way of Execution or distress And further upon mocon of of the Clerke made to this Court the Court will be assistant in recovery of the aforesaid Fines in order that the said Clerke may be allowed his said fourth or quarter part of the Fines and forfeitures to him granted by the Court as aforesaid This By law to endure the terme of Four yeares from the date hereof and noe Longer Item It is alsoe Enacted Established and Ordeyned by the Comunity aforesaid that the Clerke of this Court shall have and be payd him for the adjudgment of the age of every servant the sume of Two shillings and six pence sterl or Thirty pounds of tobacco to be payd by the Master of such servant as shall be adjudged and that the said Clerke shall have and be payd him for ever order two shillings sterling or twenty pounds of tobacco and for every Petition prefered to this Court two shillings and six pence sterling or Thirty pounds of tobacco all w.ch Fees and other Fees that shall or may be any wayes due to the Clarke of this Court shall be recovered by way of Execucon upon the body Goods or Chattles of such person or persons from whom the same shall or may be due Item It is further Enacted Established and ordeyned that the Constable of S.t Marys Citty doe twice on every Sunday (that is to say) once in |
