470 (460 that shall att any time hereafter be taken up within the said Citty the assureance or Conveyance thereof shall be enrolled in the Records of this Court and shall pay (as a Fee for the same) One hundred pounds of tobacco to the Clerke of the said Court for the time being Item It is alsoe Establis^h^ed enacted & ordeyned and be it by the said Mayor Recorder Aldermen & Comon Councillmen hereby Established enacted & ordeyned that the Clerke of this Court for the time being shall have & receive the same Fees for all busines soe by him done or to be done according as it is payd & allowed to the hon.ble secretarys of this Province for Fees of the Provinciall Court the same to be leavyed & recovered by way of Execucon signed by the Mayor for the time being Item It was alsoe enacted established & ordeyned that the Constable of this Citty for the time being shall have and be allowed the same Fee for the Execucon of his office as is allowed the sherriffe of any County of this Province by Act of Assembly or otherwise the same ^to^ be recovered by way of Execucon Notice being taken by this Court of the greate debaucherys and disorders that are Comitted in this Citty on Sundayes by severall persons by drinkeing gameing sweareing and other like grevious offences to the greate dishonour & displeasure of Almighty God the breach of the sabboth and the obstructing of the good Governm.t of this Citty to prevent which Item Itt is by the Mayor Recorder Aldermen & Comon Councillmen hereby enacted ordeyned and appoynted that noe Ordinary Keeper within this Citty shall from henceforth sell utter or dispose of by retaile or otherwise upon Sundayes any wine brandy rum or other drams or strong liquors to any person or persons whatsoever Travaillers strangers and sick people only excepted and to them speareingly and noe more then shall be thought good for their refreshment under the penalty of every Ordinary Keeper soe offending to forfeit and pay for every such default the sume of Two thousand pounds of tobacco to be levyed by the Constable of this Citty upon any the goods or Chattles of every Ordinary keeper soe offending Item And it is further by the Comunity aforesaid ordeined Established & enacted that from henceforth forward there shall be noe manner of gameing at Cards dice Ninepins or any other game whatsoever upon Sundayes Contrary to this by law shall forfeit and pay for every such offence the sume of Two hundred pounds of tobacco and be put in the Custody of the Constable till the same be paid And that the Majestrates of this Citty and every of them shall take care and see the law against breach of the sabboath the Act of Religion and other laws against Curseing swearing and drinkeing be putt in Execucon And be it alsoe Enacted and established that such Majestrate or Majestrates of this Citty or any or either |
