417 (408 Acknowledge and for and in Consideracon off the Love and affection they beare towards John Cole Nicholas Cole and Mary Guyther now wife off Thomas Guyther all off S.t Maryes County aforesaid Children off the said Sarah pties to these presents by W.m Cole Late of S.t Jeromes aforesaid Planter her first husband deced and for the raiseing off tobacco for their better advancem a livelÿ hood have given granted aliened sold and Enfeaffed and Confirmed and by these presents Doe give grannt aliene sell Enfeaffe and Confirme unto the said William Asquith his heyres and assignes for Ever All thatt tract of Land called Daÿlys Desire Lyeing in Chesipiacke Baÿ and on the Easterne side off the said Bay and in a River in the said Baÿ Called Sassafrax River formerly in Baltemore County butt now in Cæcil Countÿ on the North side off the said River begining att a maked oake standing upon a banke by a litle Cove and being The Eastermost bound tree off a parcell off Land formerly taken upp by John Collett and Runing from the said tree North and by East along the Land off the said Collet five hundred thirtÿ and three perches and one third part of a perch bounding on the North an by East by a lyne drawne East South East southerly and runing untill it intersect the head Lyne off a parcell off Land formerly taken upp by John Small peece boundring on the said Land and runing along the said Small peece Land south west unto thee first bounded tree Conteyning and Layd out for five hundred acres more or Lesse togeather with all Rights proffits and Comodityes to the same beloning (Royall Mynes Excepted) and all patents Deeds and Writings touching the same and their Rights title interest Clayme and Demand off in and to the same or any part or pcell thereoff To have and to hold the said tract or pcell off Land w.th the appurtnces to the same belonging unto the said W.m Aisquith his heyres for Ever against all pson ^or persons^ whatsoever will for Ever warrant and defend bÿ these presents the Rents and services hereafter to become due and payabl to the right honorabl the Lord prop.ry his heyres or successors for hereafter to become due and payabl to the right for the fee off the premisses only Excepted and foreprized In testimonÿ Whereoff the said Richard Bentham and Sarah his Wife have hereunto sett their hands and seales the daÿ and year first above written the marke off signed sealed and Delivered RB sealed in the presence off us Richard Bentham Ro Carvile Sarah Bentham Robert Carss SB sealed The marke off her marke W.m V B Bradÿ On the Back side off the afor Deed was Endorsed as foll Memorandum thatt the within Named Sarah Bentham Now wife off the said Richard Bentham being secretly Examined out off the hearing off her said husband doth Confese thatt shee doth freely and Volontarily give upp all her right title Clayme & demand Whatsoever off and in the within Menconed pcell or tract off Land & premisses without the feere or threats |
