405 (396 This Indenture made y.e 7.th day of March In y.e 12 year off y.e Dominion off the right honoble Charles absolute Lord & proprietor off the provinces of Maryland and Avalon Lord Baltimore &c Betweene James Cullin off S.t Maryes County in y.e province off Maryland Gentl surviveing Execut.r off y.e Last Will and Testament off Marke Cordea Late off y.e sd County Gentl Deced off y.e one part and Henry Darnall off y.e same County Esq off y.e other parte Thatt Wheras y.e right honorab Ceecilius Late Lord and propriet.r off y.e sd province off Maryland off happy Memory deced Did by his Letters patent under y.t great seal off y.e sd province of Maryld bearing date off y.e first day off Septemb.r in y.e 104.th year off y.e Dominion off y.e said Ceecilius &c annoq.r Domini 1671 for y.e Consideracon Therein Menconed Grant to y.e said Marke Cordea and his heyres for Ever All Thatt pcell off Land Called S.t Markes place Lyeing in Calvert County on y.e West side off Putoxant river and Begining at a bounded white oake by y.e side off S.t Charles Branch being y.e North west Corner tree off a pcell off Land Layd outt for Robert Ridgeley bounded on y.e East by y.e sd Ridgeleys Land and running south for five hundred perches to a bounded read oake and from y.e sd oake runing West for three hundred & seventy perches to a bounded Pohickory and from y.e sd Pohickory runing North ^to^ y.e y.e sd side off y.e sd S.t Charles branch and with the said branch to y.e first bounded tree Conteyning and then Layd outt for Eleaven hundred acres more or Lesse Hee the sd Marke by vertue off y.e grant aforesd became seized off y.e same Land in Fee and being soe seyzed in and by his Last Will and Testament in Writeing bearing date off y.e Twenty seaven ^day^ off March in y.e year off our Lord 1685 amongst other Things Therein Conteyned did give and bequeath To his Execut.r there after named all That Tract or pcell off Land Called Marks Place Containing Eleaven hundred acres Lyeing in Putoxant River being y.e same Land Called S.t Marks Place before perpentary menconed to be by them sold towards y.e payem off his debts and Legacyes and off y.e same will he did make and ordeyned his wife Hester Cordea and the above named James Cullen his Execut.r as by y.e same will remaineing off record in the prerogative office off this province may more att Large appeare and shortly after y.e sd Marke Cordea dyed after whos death the sd Hester Cordea and James Cullen proved y.e sd will in due forme off Lawe and tooke upon them the burthen off off y.e sd Executor shipp since w.ch time y.e sd Hester Cordea is departed this Life and the sd James Cullen is now become the sole surviveing Executor Now This Indenture Wittnesseth That y.e sd James Cullen in pursuance off y.e trust in him reposed in and by y.e sd will and y.e better to Enable him to performe y.e same and to pay and discharge the debts and Legacÿes of y.e sd Marke Cordea and for and in Consideration off y.e sume off one hundred pounds off Courant Law full Monÿ of England by him y.e sd Henrÿ Darnall paid in manner and forme following Thatt is to say y.e sume off thirty & five pounds part off y.e sd one hund pounds paid by y.e order and request off him y.e sd James Cullen to W.m Boareman Late Called Mayor off S.t Maryes County Gent for his Equitable right & title to y.e sd Land By vertue off a Certaine deed Theroff Made by y.e sd Marke Cordea to mary The Wife off y.e sd W.m Boreman Late Called Mary Jarbo w.ch was Never Legally Executed and Now delivered upp to bee Cancelled and y.e sume off sixty & five pounds residue off y.e sd 100.ll paid to y.e sd James Cullen att and before the Ensealing & deliverÿ off These psents and for divers other Consideracons him y.e sd James hereunto specially Moveing hath given granted bargained sold aliened and Confirmed and by These psents doth give grant bargaine sell alien & Confirme unto ^him^ y.e sd Henry Darnall his heirs and assignes All Thatt the before Menconed parcell or tract off land Called Markes place otherwise S.t Markes place Lyeing in Calvert County afsd Containing Eleaven hundred acres off Land as afsd and herein before perticularly sett forth and described together with all y.e right proffit and appartum.s to y.e same belonging or in any wise apperteyning and ^also^ his y.e sd James Cullen his right title interest property Clayme & demand whattsoever in or to y.e same or anÿ part thereof To have and to hould the sd parcell off Land and appurtinances to him The said Henry Darnall his heyres and assignes for Ever to the only proper use off |
