369 (360 By the Dep.ty Govern.r To all whome these p.rsents shall come Greeting Know ye that upon the sixteenth day of Aprill Anno Dm 1685 Annoq Peyni Peyes 37 before me the last will and Testam.t of William Yeilder Marrin.r was proved approved and allowed And therefore Charles Gosse Executor in the said will nominated by the name of Charles Gosse is admitted to take into his Custody & possession and to administer on all the goods Chattells dues accounts and other of the estate of the said Deced which I hereby publisize and make known to all Judges Justices Clerkes Marshalls and Bayliffes whatsoever the said Charles Gosse having been sworn to bring into the Secretaryes office within sixteen dayes a true and perfect Inventory of all and every the said deceds Estate w.ch hath shall or may come to his hands possession or knowledge there to be recorded and the said Charles Gosse is to pay all just debts & Lagacyes And to perform such other things as our Exe.rs ought to doe according to Law Given under my hand and seal att Armes this Twenty eighth day of Aprill Anno Dm 1685 PP.s 37.o (sealed) John Godfrey May the fourth 1686 Then came before me Francis Garree aged Fourty yeares or therabouts and made oath that he saw John Godrey Dep.ty Govern.r of South Carolina whose name is subscribed to the above written letters Testamentary or Certificate sign seal & deliver the said Letters Testamentary or Certificate to Charles Gosse the therein Exe.rs nominated he the said Frances Garree being then in company with the said Gosse & the said Godfrey att Charles Town in Ashly River in South Carolina aforesaid Coram me Henry Darnall Recorded the 8.th day of May 1686 P Jam Heath Cl Maryland ss To all Christian People to whom these p.rsents shall come greeting in our Lord God Everlasting know yee that I Daniell Pensax of London Marrryner have assigned ordained and made and in my stead and place by these p.rsents have put & constittuted my trusty and well beloved Freind Coll William Stevens of Sumersett County in the Province of Maryland to be my true and Lawfull Attorney for me and in my name and to my use to sell Lett or Sett the Plantation called by the name of Clynncarth scituate lying and being on the Easter shore in Poccomoke River in the Province aforesaid and the Stock of Cattle and Hogges thereunto belonging both or either of them Covenanting to my said Attorney for my self my heires Executo.rs & Admistra.rs to ratifie and confirm what my said Attorney shall Lawfully doe in the p.rmises And further desiring and impowring my said Attorney to doe what he thinks fitt or can for the better securing of the Title of the above said Tract of Land And all charges about the settling and securing of the plantation aforesaid I doe hereby promise to pay to my said Attorney holding firm and stable all and whatsoever my said Attorney shall lawfully doe or cause to be done in or about the premises by vertue of these p.rsents as if I were there in mine own person p.rsent In Testimony whereof I have hereunto sett my hand and seal this 21 day of Aprill 1682 Signed Sealed & Deliv.rd in the p.rsence of Daniel Pensax (sigill) Henry Lowe There came before me Robert Lee one of the wittnesses to the Robert Lee above mentioned Lre of Attorney and made oath upon the holy Evangelists that he saw Daniel Pensax signe seal & Deliver the same as his act and deed Sworn before me this 12.th of May 1686 W.m Digges |
