333) 342 up some controversyes as also according to said Underwoods advise (to said Estis to bring the said shipp and goods into his the said Underwoods Creeke as also the said Underwood then promised to send a sloop to meet the said ship In order to to receive from on board such goods as were prohibited then accordingly this Deponent went and haveing to the best of his Judgem.t settled all disteneares betweene the said Estis and the said Mechants and between the Fraighto.rs and principall Merchant One M.r Lynch that then they with this Deponent according to the advise aforesaid Underwood sett sayle for the Creeke aforesaid and the said sloope not meeting us as expected This Dep.t craved leave of the sayd Estis to send his Yoale with this Deponent to see whether the Mann of Warr rode neere S.t Georges as alsoe what stayed the Expected sloope w.ch being accordingly done the said Cap.t Estis then at S.t Jeromes putt a shoar a percell of Servants That after this Deponent being roed as aforesaid to M.r Underwoods Creeke he imediately found noe likelyhood of the Sloop w.ch soe insered this Depon.t that he was unwilling to conserve himselfe therein but that he the said Underwood went in person with this Deponent to meet the said Ship and with her returned to the Creeke called S.t Innagoes where being arrived That at the request of the Merchants and Master this Deponent lent his men to helpe land such goods as said Mach.ts ordered That this Dep.t saw one of S.t Marchants Christopher Mason Imploying himselfe in takeing an account of the persells soe landed and that another went with the boates to see and take accompt of them in the Cellar and this Dep.t in the behalfe of the said Merchants Enquired of said Underwood where the said goods should be Cellared that the said Underwood ordered a parcell of Wynes to be landed in his Baren with strawe to be layed on them and the Dry goods to be putt into a Certaine Cellar That this Dep.t saw severall persells of Caske Bales Boxes and Fardells with some boults of Canvis or osonbricks loose hatts &c and that the same might the said Underwood came to this Dep.t and told him that M.r Clarke then lodger in the house was resolved to informe Majo.r Sewall at w.ch this Dep.t being much greeved went imediately to M.r Llewellin to make the first Informacon in favo.r of the said Merchants and Cap.t Estis and that the said Llewellin not being quallified to receive such Informacons this Dep.t did then goe on board and informed the said Estis and Merchants how they were betrayd that then at the request of the said Estis and Merchants this Dep.t w.th One Dudly then make of said ship did p.rpare to make the first Informacon w.ch accordingly had been done had not M.r Underwood persuaded this Dep.t that his owne goeing would be more to the ship and Merchants advantage to w.ch this Dep.t at last consented that the next News was that the Hon.ble Majo.r Sewall and after him the hon.ble Coll Darnall were comeing w.ch accordingly hapned And the said Underwood goeing with the said Majo.r Sewall to seize the said Wyne that then this Deponent suspecting his faylure in the trust imposed in him did then at the request of the said Merchants lend them his ments Convey the goods to one M.r James Yores which in order whereto this Dep.t with one M.r Cousat The Merch.ts and foure of said Dep.ts were (Came |
