329 (320 Now here at this day to witt the sixth day of March in the yeare of our Lord 1684 Came the said Nehemiah Blackiston and Samuel Cooper who aswell for our Soveraigne Lord the King and the Cheife Governo.r aforesaid as for themselves by their Attorny aforesaid And the said John Woodside by his said Attorny likewise came and the Juro.rs of that Jury came alsoe to witt Cap.t Henry Smith Thomas Joce Nicholas Tenett Robert Smith Cornelius Watkinson George Ashman Christopher Nutter Thomas Miles John Sewall Walter Woolverstone Henry Lewis and Peter Gard who to say the truth in the p.rmisses being elected tryed and sworne upon their oathes doe say that they find the said John Woodside Guilty of the p.rmisses in manner aforesaid in the Informacon above alleadged against him Whereupon it is Considered by the Court here That the Comoditys goods wares and Merchandizes aforesaid in the Informacon above specified And the shipp aforesaid with all her guns tackle furniture amunicon and apparrel be lost and forfeited according to the forme of the statute aforesaid viz.t one third part thereof to our said soveraigne Lord the King and the other third part thereof to the Lord Prop.ry Cheife Governo.r of this Province and the other third part thereof to the said Nehemiah Blackiston and Samuel Cooper who aswell for our soveraigne Lord the King and the said Lord Prop.ry Cheife Governo.r as for themselves prosecute according to the forme of the Statute aforesaid in that case made and provided And the Defendt in Mercy &c It is alsoe Ordered by the said Court by and with the Consent of the said Nehemiah Blackiston and Samuel Cooper who aswell &c That Cap.t Jn.o Osbourne M.r James Dasheel M.r Richard Whitty and M.r John King all of somersett County Bee and are appoynted Appraisors To veiw appraise and vallue the said Shipp amunicon guns tackle and apparrell and goods therein brought to the best of their understanding and knowledge on or before the Last day of March instant And that on or before the said last day of March instant they the said Appraisors under their hands and seales deliver into the hands of Coll William Stevens of the County aforesaid Collecto.r in those parts and especially appoynted (since the death of M.r Christopher Rousby to secure his Majestys imposicons and duetys the parte aforesaid the Appraisem.t by them to be made in writeing Who is also by the said Court Ordered with all possible speed to transmitt and send the same to the said Hon.ble Coll Henry Darnall Coll William Diggs and Nehemiah Blackiston aforesaid or any or either of them And the said Coll William Stevens is by the said Court authorized and Impowered to Administer the usuall oath of an Appraisor to the aforesaid Appraiso.rs And that the said Coll William Stevens and the said Sam.ll Cooper Deputy Comptroller and Surveyo.r of his Majestys Customes rates duetys and Imposicons in Somersett County forthwith take an accompt in writeing of the wages due to each particular Seaman in or belonging to the said ship And to report and send the same together & with the Appraisem.t aforesaid to the said Coll Darnall Coll Digges and Nehemiah Blackiston or any or either of them to the end the same may be duely payd out of the vallue or sume of the said Appraisem.t And the said Court also Orders That the said Master be the first treated with in order to the purchaseing againe of the said shipp And that the said Appraisors are to take notice that the goods menconed in the said Informacon and by them to be appraised are as followeth viz.t Tenn peices of Irish Freeze Tenn duzin paire of shooes Fourty course Hatts Five duzin paire of Course Stockins Afterwards the aforesaid Appraisors made returne of Appraisem.t of the aforesaid ship and goods as follow viz.t March |
