319) 328 goods be there Seized Enformed against or such for or Otherwise that third part alsoe to his Majesty his heires and Succeso.rs and the other third part to him or them who should seize Informe and sue for the same in any of his Majestys Courts in such the said lands Islands Cullonys Plantacons Territorys or places where the Offences was comitted or in any Court of Record in England by bill Informacon plaint or other Accon wherein Noe Essoyne protection or wager of law should be allowed as in the statute amongst other things is more fully contayned w.ch said Statute is yett in full force and unrepealed Nevertheless the said John Woodside Master or Comander of the said ship or Vessel Robert of Larue well knoweing the Statute aforesaid to be in full force and unrepealed but the same statute not weying Nor the paines penaltys and forfeitures in the Same contained anywayes reguarding afther the said Twenty Fifth day of March 1664 in the said Statute menconed that is to say the Fourth day of February in the yeare of our Lord 1684 then rideing at Anchor in the River Moanokin in the County of Somersett in the Province of Maryland within the Jurisdiccon of this Court then and there did import and bring into the said Province of Maryland in the said shipp or Vessell called the Robert of Larue diverse and Sundry goods & Merchandizes of the growth production and manufacture of Europe which were not really and bona fide shipped loaden or taken in in England Wales or Towne of Barwick upon Tweed but were by the said John Woodside shipped laden and taken on board the said ship or Vessell called the Robert of Larue in the Kingdome of Ireland that is to say Tenn peices of Irish Frize Tenn duzin paire of shooes forty course hatts Five duzin paire of Cours stockins And the said John Woodside did then and there Out of the said shipp or Vessell unlade the severall goods before herein menconed and other Europian Comoditys so as aforesaid by him the said John Woodside shipped and Imported against the forme of the statute aforesaid in that case made and provided Whereupon the said Nehemiah Blackistone and Samuel Cooper aswell for the said lord the King and the said Lord Prop.ry as for themselves pray the Advice of the Court in the p.rmisses and that the said John Woodside Master or Comander of the said shipp or Vessell with all her guns Called the Robert of Larue may forfeit the said ship or Vessell with all her guns Tackle amunicon furniture and Apparrell and all the said goods and Comoditys before menconed According to the forme of the statute aforesaid and that the same forfeiture may be divided into three equall parts one third part thereof to our Soveraigne Lord the King one third part to the said Lord Prop.ry Cheife Governo.r as aforesaid and the other third part thereof red residue of the said Forfeiture to them the said Nehemiah Blackiston and Samuel Cooper according to the forme of the said Statute and that the said John Woodside may come into Court to answere our said Soveraigne Lord the King the said Lord Prop.ry Cheife Governo.r as aforesaid and the said Nehemiah Blackiston and Samuel Cooper who aswell for the said Lord the King the said Lord Prop.ry as for themselves in this behalfe prosecute of and upon the p.rmisses &c And the said John Woodside Master of the shipp aforesaid by Kenelme Cheseldyn his Attorny Cometh and defendeth the force and Injury when &c And sayth That he is not guilty of the breach of the statute aforesaid in manner and forme as is above Imposed upon him And this he desires may be Enquired of by the Country and the Plaintiffe alsoe Therefore it is Comanded the sheriffe of S.t Marys County that he cause to come here Twelve &c by whome &c and who neither &c To recognize &c because of (Now |
