303 (294 Memorandum That the within written Indenture with the Lands and premissess therein mentioned was before us the fifth day of March anoq Dom one Thousand six hundred Eighty and three acknowledged by the within named Nicholas Nicholson to be his act and deed to be the Right of the within named Giles Yallopp his heires and assignes for Ever and at the same day and time Hester Nicholson the wife of the said Nicholas Nicholson being secretly Examened out of the hearing of her said Husband did freely Cleerly and voluntarily confess that she did give up all & singullar her right tittle Claime and demand whatsoever of and in the within mentioned Land and premissess without any feare Threate or displeasure of her said husband In testimony whereof wee have hereunto subscribed our names the day and year first above written Anoq Domj 1683 Thomas Taillor William Burges Recorded the seaventeenth day of March Annoq Dm 1683 P Tho Grunwin Clk Know all men by these presents that I Nicholas Nicholson of Annarrundale County in the Province of Maryland March.t am held firmly Bound unto Giles Yallopp of the said County of Annarrundale Merchant in the full sum of Eighty pounds of good and Lawfull mony of England to be paied to the said Giles Yallopp or to his Certaine Attorny his Execut.rs Admin.rs or Assigness to the which payment well and truely to be made & done I bind myself my heires Exe.rs and Adm.rs firmely by these presents sealed with my seale dated the fifth day of March Annoq.r Domj 1683 The Condition of this present above written obligation is such that if the above Bounden Nicholas Nicholson his heires Exers and Administrators and Every of them shall and will from time to time and at all times forever hereafter well and truely observe performe fulfill and keep all and singuler the Covenants Grants articles Clauses and agreements mentioned Contained and Expressed in one Certaine Indenture of Bargaine and sale or feoffement bearing Even date with this present abovewritten obligation had and made by and between the above bounden Nicholas Nicholson and Hester his wife of the one part and the aforesaid Giles Yallopp of the other part which on the part and behalfe of the said Nicholas Nicholson his heires Ex.rs & adm.rs are and ought to be observed performed fulfilled and kept and that in and by all things according to the true Intent and meaning of the before said Recited Indenture Respectively in all points and Conditiones That then the present above written obligatione shall be void and of noe Effect otherwaise to stand and Remaine in full pouer force strength and vertue Signed sealed and delivered Nicholas Nicholson in the presence of us Thomas Taillor (sealed) William Burges Acknowledged before the persones signed to the deed March the 5.th 1683 Know all men by these presents that I William White of Baltemore County in the Province of Maryland Gunnsmith have assigned ordained and made and in my stead and place by these presents putt and Constituted my true and well beloved friend James Phillips of the same County and Province aforesaid Innholder to be my true and lawful Attorny for me and in my name and to my use to aske sue for Leavie require recover and Receive an order of Court w.t cost of suite formerly obtained against Henry Stocket and James Stavely Ex.rs of the Estate of Thomas Palmer on my behalfe the former ord.r taken out by me my Attorny and Execution being Neglected and not served by sybre then sherriffe have Authorized and Impowred my said Attorny James Phillips to do Execute and performe all such thing and things demise or demises whatsoever in the Law for the Recovery of order of Court Cost of Suit and Executione and in my name to do Execute and perform a fully Largely and Amply in Every Respect to all intents Constructions and purposes as I my selfe might or could doe if I my selfe were personally present Ratifieing and alloweing and holding firme and stable all and whatsoever my said Attorny shall doe or cause to be done Lawfully in or about the Execution of the premissess by vertue of these presents In wittness whereof I have hereunto sett my hand & seale the 29.th day of March Annoq.r Domj 1684 Signed sealed and delivred William White (seal) in the presence of us John Hathway William Osbourne |
