254) 264 Richard Johns to bee the right of the within named Richard Gwinn and James Kyle their heires and Assignes for ever And att the same day and time the within named the said Elizabeth Johns wife of the said Richard Johns being secretly examined out of the hearing of her said husband Did freely cleerly and voluntarily Confesse that shee did give up all and singuler her right title Dowry claime and demand whatsoever of and in the within named parcell of land and p.rmisses without any feare threats or displeasure of her said Husband to be the right of the said Richard Gwinn and James Kyle their heires & Assignes for ever In Testimony whereof wee have hereunto subscribed our names the day and yeare first above written Thomas Tailler W.m Burges Know all men by these p.rsents that I Richard Johns of the Clifts in Calvert County Merchant am holden and firmely bound to Richard Gwinn of Ann Arundell County Planter and James Kyle of the same County Cooper in the full sume & iust quantity of Fourteen thousand pounds of good sound and every way well Condiconed Merchantable tobacco & Casq.r To be payd to the said Richard Gwinn and James Kyle or to either of them their or either of their certaine Attorny Exec.rs Adm.rs or Assignes To which paym.t well and truely to be made and done I bind my selfe my heires Exec.rs & Adm.rs firmely by these p.rsents sealed w.th my seale Dated the Three & twentyeth day of March Annoq.r Dne 1681 The Condicon of this p.rsent above written obligacon is such that if the above bounden Richard Johns heires Exec.rs & Adm.rs & every of them shall & doe from time to time and at all times for ever hereafter well & truely observe performe fullfill and keep all and singuler the Covenants grants articles clauses and agreem.ts menconed Conteined & expressed in Our certain Indenture of bargaine and sale or Feoffment bearing date with this p.rsent above written Obligacon had and mad by and between the above bounden Richard Johns & Elizabeth his wife of the one part and the aforesaid Richard Gwinn and James Kyle of the other part which on the part and behalfe of the said Richard Johns and Elizabeth his wife their heires Executo.rs and Adm.rs are and ought to be observed performed fullfilled and kept and that in and by all things according to the true intent and meaning of the said recited Indenture respectively in all points & Condicons That then this p.rsent above written obligacon shalbe voyd & of none effect otherwise to stand & remaine in full force & Vertue Signed sealed & delivered in the p.rsence of Richard Johns (sealed) Memorand that that the above (and Elizabeth his wife) was interlined before the insealing hereof Sam.ll Bourne Tho Sterling Geo Parker W.m Holland To all Christian People to whome these p.rsents shall Come to be seen read or heard I Edward Perrin of the Citty of Bristoll within the Kingdome of England Merch.t and now resident att the Clifts in Calvert County in the Province of Maryland send greeting Whereas I the said Edward Perrin being now bound out of the said Province of Maryland to the Citty of Bristoll aforesaid the place of my abode And whereas I the said Edward Perrin doth thinke it needfull in my absence to put some person in trust with my affaires in the said Province of Maryland |
