197) 206 This Indenture made the twelfth day of July in the yeare of o.r L.d God One thousand six hundred seaventy nine & in y.e fourth yeare of the Dom of Charles over this Province &.ca between Edward Husband of the one party and Nicholas Painter on the other party Witnesseth y.t y.e s.d Edward Husband for & in Consideracon of the sume of sixteen thousand pounds of Tobacco in Casque already ^in hand^ received before the signing & delevery of these presents well & truly paid doe acknowledge himselfe fully sattisfied & paid & thereof & of every p.t thereof do Clearly acquit & discharge the said Nicholas Painter his Heires Executo.rs & Administrato.rs & every of them forever by these presents have bargained sold granted aliend & Confirmd & by these presents do grant bargain sell alien & Confirme unto y.e s.d Nicholas Painter his Heires & Assignes for ever all that pcell of Land lying on the North side of Sassaphrax River in the Province afores.d Conteyning sixteen hundred Acres more or less Comonly Called by the name of Painters Rest & the s.d Edward Husband for himself his Heires Executo.rs & Administrat.rs do Covenant promise and Grant by these presents to and with the sd Nicholas Painter his Heires Executo.rs & Administrato.rs well & truly to deleiver or Cause to be deleivered unto the sd Nicholas his Heires or Assignes all y.t pcell of Land lying & scituate as afores.d with all y.e appurtenances thereto belonging by these presents bargained & sould to the sd Nicholas & his Heires for ever y.t is to say that the sd Edward Husband for & notwithstanding any act or thing by him Caused or procured to y.e Contrary thereof now are or is & at y.e Execucon of the p.rmisses to y.e s.d Nicholas & his Heires according to y.e true intent & meaning of these presents shall then be sorly seased & every Prone of the sd Land Called Painters Rest bargained & sould of a good Lawfull & Indefeasable Estate without any manner of Condicon or Limitacon of any use or uses & have now & at the Execucon of y.e s.d Estate shall then have good Right full power & lawfull & absolute authority to grant bargain sell &.ca & that he the sd Edward Husband & his Heires haveing Lawfully or Claiming to have any manner of Title or Interest of in or to the p.rmisses bargained & sould with all y.e appurtenances thereto belonging by from or und.r the sd Edward Husband from time to time & at all times for & duering y.e space of two yeares next ensueing the date of these presents when & as often as he shall be thereunto reasonably required by the sd Nicholas his Heires or Assignes or any of them make doe suffer knowledge & execute or Cause to be made done suffered knowledged & executed at the Cost & Charge of the sd Edward Husband all & every such lawfull & reasonable Act & acts thing & things devise & devises assurance & assurances in Law whatsoever for the further better & more perfect assurance & assurances ^Conveyance^ of y.e p.rmisses aforesd to the sd Nicholas Painter his Heires & Assignes according to the true intent & meaning of these p.rsents by any means whatsoever ag.st him the sd Edward Husband & his Heires without warranty as aforesd or any means in Lawe whatsoever provided alwaies & it is Covenanted Concluded Condiconed and agreed by & between y.e s.d party to these presents y.t if the sd Edward Husband his Heires Executo.rs Administrato.rs or Assignes or any of them do well & truly Content & pay unto Nicholas Painter his Executo.rs or Assignes y.e full and just quantity of sixteen thousand pounds of Tobacco in Casque at two paym.ts Id Est the one halfe being Eight thousand pounds of Tobacco upon the last day of Decemb.r next ensueing the date hereof w.ch will be in the yeare of o.r Lord One thousand six hundred seaventy nine & y.e other paym.t to be made on the last of Decemb.r in y.e yeare of o.r Lord One thousand six hundred & Eighty in form ensueing without fraud or guile that then this present bargaine & saile & all & every Covenant grant & article & thing herein Conteyned shall to |
