2 Merchant being weake in body but praised be
the Almighty of sound perfect & disposein memory doe make this my last Will & Testam.t in manner & forme following that is to say first & principally I comitt my soul into the hands of God that gave itt me & my body to the earth to be buried in a decent manner att the discretion of my Execut.x herein after named And as for & concerning all such worldly Estate God of his goodnesse hath blessed me with I will dispose & bequeath the same in manner following that is to say as for & concerning all such tobacco & other Goods I have in Leverpoole aforesaid after my just debts funerall Expences & probate of this my last will paid out of the same I will devise & bequeath the same to my deare wife Gertrude Anderton & my two sonns John & Francis Anderton And as for & concerning the Arreares of an Annuity of tenn pounds granted by my late Father by his last will out of the Demesne lands of Birchley in the said County my will is & I doe hereby give & dispose the same to my said wife & sonns And as touching & concerning all such my lands in the Province of Maryland my will & minde is & I doe hereby give the same first to my said wife Gertrude for her life for & towards the maintenance & the maintenance of my said two sonns And after her decease then to my said two sonns John & Francis Anderton & their heyres for ever And my will is that neither my wife or sons ever goe over to the said Province of Maryland to dispose of the profitts of the said lands but doe hereby give liberty to my Exec.x to sell & dispose of the said lands And the consideracon thereof & for the said lands obtained to lay out in the purchase of some Estate either in Fee simple or for ever att the discretion of my Exec.x in the Realme of England for the use of my said wife for life And the residue of the Estate & terme therein purchased to & for the said John & Francis Anderton my sonns & their heyres as aforesaid And of this my last will I hereby nominate & appoint my said wife Gertrude my Executrix & In wittness whereof I have hereunto putt my hand & seale this 29.th day of July Ano [illegible] scdi Anglie Annoq Ind 1675 Sealed & published in p.rsence of Roger Anderton W.m Gandy & George Barber Probatum approbatum & insinuatum fuit hijusmodi Testamentum Johannis Anderton Mercatorie per defuncti; ac C viribus et Valore ejusdem cuuatitum colare noblius Johannes Wainwright legum doctore reverendi in Christopatrie & Domini Domini Johannis pmiss dioina Cestriensie Episcopi Vicario in spiritualibus generali & officiali legittimue sulcito decimo octavo die Mensie Augusti Anno Domini Millecimo sexiculesimo septuagisu quinto & comissa fuit Execuce ejusdem ac Administratio ominium et singulorum benom Jurium Creditorum et Chatallorum ipine defuncti Gertrude Anderton Vidae nette Iri defuncti ac unice Executrici in eidini nominate (primitus decadem bene & fideliter Administrando Testamentuing p Edictum & omnia & implendo Nec nonde vero & pleno eorundem Juventario exhibendo deg fideli computo calculo sine Raciocimo de et supe p.rmisse nobis aut aly Indici in hac parte competonti cuicung quum & quoties legitime fuerit requisit reddendo ad sacta Dei Evaligelia jurcat) Salvo june cujuscuing dat sub sigillo officis nri pld die Mensie Annoq Vin pld L Fogg Surn Guliel Wilson Vera copia concordat cum Original Testament Reg.r Dep probacoe ejusdem & bris Administrator suginde conerssis Ex.a &&&j.o Augusti 1676 & Sam Fazalerley Notar public Liverpoole This Indenture made the fourth day of Decemb.r in the forme & fortieth yeare of the Dominion of Cæcilius &c And in the yeare of our Lord God 1675 Betweene Garret Vanswearingen of the Citty of S.t Maryes in the Province of Maryland Innholder and Barbara his wife of the one part And Robert Ridgely of the said Citty of S.t Maryes in [illegible] Witnesseth that the said Garrat & Barbara [illegible] pounds of tobacco to them in hand paid by the said Robert the [illegible] if they the said Garrat & Barbara doe here [illegible] thereof the said Robert Ridgely his heyres |
