161 (152 County aforesaid for the Errors in the Record and processe aforesaid bee revoaked adnulled and altogether held for nothing And that the said William Bourne unto all things w.ch by occasion of the Judgment aforesaid hee hath left bee restored and that the said William Bourne Recover against the said James Rigby the sume of thirteen hundred eighty eight pounds of tobacco For his Costs of suite in the behalfe expended February y.e 6.th 1679 George Hollinsworth aged about two and twenty yeares sworne saith that hee the Depon.t came in Cap.t Paggen his about three yeares since w.th one William Bourne whome the Depon.t knoweth well w.ch Bourne was sold after the shipps arrivall but to whome this Deponent knoweth not & after hee the said Bourne was sold hee this Depon.t saw the Doctor of the said shipp and Cap.t Paggen walking upon the Dock together and the Doctor alsoe Capt Paggen how long hee had sold the Cooper For and Cap.t Paggen Answered for three yeares And that his Indenture was for noe more And further this Deponent saith not Juratt Coram me Thomas Tailler Geo H Hollingsworth signum Peter Paggen aged about thirty yeares saith That William Bourne and Susanna his wife was transported into this province & disposed of by this Deponent to M.r James Rigby by his Indenture w.ch I the Deponent suposed was For foure yeares but when I the Deponent asked the said William for to see his Indenture hee brought it to me the Deponent and then the said William's Indenture had the word in the word in the true place of the line scratcht out and in the space overhead the word (three) was written For w.ch I the Depon.t extreamly blamed him the said William and said that in regard his the said Williams Indenture was interlined it would in Lawe prove invallid should any Difference arrise but howsoever I the Deponent told the said William I would stand his Friend and that M.r James Rigby should promise me the Deponent that hee the said William should serve noe more then Foure yeares of w.ch proceedings w.th the s.d William I the Depon.t informed M.r James Rigby who did then promise to me the Depon.t that in case the said William should quietly serve Foure yeares hee the said James Rigby would take noe advantage of that razed Indenture And soe took the said W.m from me the said Deponent Peter Paggen February y.e 1.st 1679 Then sworne before me Thomas Tailler To all Christian people to whome this p.rsent writeing shall come I Martine Stampe of Thavies June London Gentl Executor of the last will and Testament of Timothy Stampe my Brother late of the Citty of Bristoll Marchant send greeting Whereas my said Brother Timothy Stampe being at the time of his death posessed interested and served of seaverall goods Marchandizes Farmes Lands Tenements w.th th appurtenances thereunto belonging lying in Virg.a and Maryland Therefore Know yee that I the said Martine Stampe have made Constituted Ordained authorized appointed and in my place by these p.rsents have putt my Well beloved Friend Thomas Jones of the said Citty of Bristoll Marchant my true & Lawfull Attorney and Comission.r as well to enter for me and in my name unto all & singular the Farmes Lands Tenements and to Grant bargaine and sell the same by Deed or otherwise as alsoe to sell and dispose of the said goods and Marchandizes as my said Attorney shall (think |
