15 Lord Barron of Baltemore &c To the Sheriffe of S.t Maryes County Greeting Whereas Thomas Gerard Gentl lately in Our Provinciall Court before Our Justices att the Citty of S.t Maryes by the Consideracon of the same Court had recovered against the Estate of Thomas Gerard Esq.r deceased aswell the Sume of Thirty five Thousand pounds of tobacco for his Damages which he hath Susteyned by occation of A Certaine Accon of Trespasse upon the Case by the said Thomas Gerard Gentl brought in Our said Court against John Gerard and Rose Gerard Exec.rs of the last will and Testament of the said Thomas Gerard Esq.r Deceased whereof they are Convict as alsoe the sume of Two Thousand and Eight pounds of Tobacco more for his Costs and Charges in that behalfe layd Out and Expended And thereupon by Our writt Wee have lately Comanded you that of the Goods and Chattells of the said Thomas Gerard Esq.r Deceased if they Should be found in yo.r Balywick you cause to be made the Severall Sumes aforesaid and the same in yo.r Custody Deteyne ready to Deliver unto the Said Thomas Gerard Gentl Whereupon you made returne you had Caused to be Leavyed of the Goods and Chattells of the Said Thomas Gerard Esq.r Deceased in yo.r Balywick the Sume of Fourteene hundred pounds of Tobacco parcell of the Damages and Costs aforesaid which said Tobacco you had ready to render to the aforesaid Thomas Gerard Gentl for part of the Damages and Costs Aforesaid And further that the said Thomas Gerard Esq.r had not any other Goods or Chattells in your Balywick whereof the Residue of the Damages and Costs Aforesaid or any part thereof you could Cause to be made And Because the said Thomas Gerard Gentl in the same Court before Us Chooseth to be delivered unto him all the Goods and Chattells of the aforesaid Thomas Gerard Esq.r besides his Oxen and Affros of his Cart And in like manner the Moyety of all his lands and Tenem.ts in yo.r Baliwick To hold to him the Goods and Chattells aforesaid as his owne proper Goods and Chattells and the Moyety aforesaid as his freehold to him and his Assignes according to the forme of the Statute in that Case made and Provided untill the remainder of the Damages and Costs aforesaid shall bee thereupon Leavyed And therefore We Comand you that all the Goods and Chattells of the aforesaid Thomas Gerard Esq.r besides his Oxen and Affros of his Cart And in like manner the Moyety of all his lands & Tenem.ts in yo.r Balywick of which he was Seized att the time of his death to the aforesaid Thomas Gerard Gentl you Cause to be Delivered by Reasonable price and Extent To hold to him the Goods and Chattells aforesaid as his owne propper Goods and Chattells And the Moyety aforesaid as his freehold to him and his Assignes according to the forme of the Statute aforesaid untill the Residue of the Damages and Costs aforesaid shall be thereupon fully Leaveyed And in what manner you shall Execute this Our writt you shall make appeare before our said Court the Eight and Twentyeth day of November next And have You there this writt Witnes Our Trusty and Welbeloved Thomas Notley Esq.r Our Depty Lieutenant and Cheif Justice of Our said Province of Maryland the Thirteenth day of September in the First yeare of Our Dominion &c Annoq Domini One Thousand six hundred Seaventy and Six William Calvert Secretary Att which said Eight and Twentyeth day of November the same sheriffe maketh returne of the writt aforesaid with an Inquisition thereunto Annexed the Terme whereof followeth in those words (viz.t) S.t Maryes County fs An Inquisition Indented taken att Greenspring on Basford Manno.r in the County aforesaid the Second Day of November in the First Yeare of the Dominion of the Right Hon.ble the Charles &c over this province Annoq Domini 1676 before me Clement Hill sheriffe of the County aforesaid by vertue of A writt from the Lord Propry to me directed and to this Inquisition Annexed by the Oathes of John Hoskins John Gee John Bullock Vincent Mausell Robert Atkins and Edward Turner all of the County aforesaid who say upon theire Oath that Thomas Gerard Esq.r in the writt aforesaid named being indebted as in the writt is Specified was Seized in his Lordpp as of Fee of the Manno.r of S.t Clement in the County aforesaid of the Cleare yearly Vallue in all Issues and Profitts of Six Thousand Three hundred and Eighty Pounds of Tobacco And of the Manno.r of Basford in the County Aforesaid of the Cleare yearly Vallue in all Issues & Profitts of Nineteene hundred & Seaventy pounds of Tobacco And further the Jurors aforesaid upon theire Oathes Say that the Aforesaid Thomas Gerard Esq.r hath noe Goods nor Chattells nor other lands and Tenements in the County aforesaid to theire Knowledge (that |
