DEFERRED HIS RETIREMENT IN ACCORDANCE WITH THE PROVISIONS
OF SECTION 11(15) OF THIS ARTICLE, THE BASE SHALL BE THE
CONSUMER PRICE INDEX FOR THE CALENDAR YEAR ENDING
DECEMBER 31ST OF THE FISCAL YEAR IN WHICH HE ATTAINED THE
AGE OF 60.

SECTION 2. AND BE IT FURTHER ENACTED, That Section
195A(b)(1) of Article 77 - Public Education, of the
Annotated Code of Maryland (1969 Replacement Volume and
1974 Supplement) be and it is hereby repealed and
re—enacted, with amendments, to read as follows:

Article 77 — Public Education

195A.

(b) (1) Each retired member shall have a base which
shall be the consumer price index for the calendar year
ending December 31st of the fiscal year in which he was
last employed [.], EXCEPT THAT AS TO ANY MEMBER WHO
DEFERRED HIS RETIREMENT IN ACCORDANCE WITH THE PROVISIONS
OF SECTION 195(10) OF THIS ARTICLE, THE BASE SHALL BE THE
CONSUMER PRICE INDEX FOR THE CALENDAR YEAR ENDING
DECEMBER 31ST OF THE FISCAL YEAR IN WHICH HE ATTAINED THE
AGE OF 60.

SECTION 3. AND BE IT FURTHER ENACTED, That Section
53A(b) (1) of Article 88B — State Police, of the Annotated
Code of Maryland (1969 Replacement Volume and 1974
Supplement) be and it is hereby repealed and re—enacted,
with amendments, to read as follows:

53A.

(b) (1) Each retired member shall have a base which
shall be the consumer price index for the calendar year
ending December 31st of the fiscal year in which he was
last employed [.], EXCEPT THAT AS TO ANY MEMBER WHO
DEFERRED HIS RETIREMENT IN ACCORDANCE WITH THE PROVISIONS
OF SECTION 53(15) OF THIS ARTICLE, THE BASE SHALL BE THE
CONSUMER PRICE INDEX FOR THE CALENDAR YEAR ENDING
DECEMBER 31ST OF THE FISCAL YEAR IN WHICH HE ATTAINED THE
AGE OF 50.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
