MONTGOMERY COUNTY

3.    "Dedication plat" — any plat conforming to
law, duly recorded among the land records of the county,
which has the legal effect of dedicating one or more
rights of way to public use, and, where any such
dedication plat has been recorded subsequent to the
creation of the Maryland—National Capital Park and
Planning Commission, the approval of that body corporate
has been affixed thereto where the property concerned
lies within its jurisdiction.

4.    "Director" — the director of the County
Department of Transportation and his duly authorized
agents.

5.    "Drainage structure" — any culvert, bridge,
storm sewer, catch basin, canal, ditch, subsurface drain
and any other structure or watercourse designed to carry
off surface or other waters.

6. "Pedestrian Walkway" — any land, way or path
designated by appropriate signs for use as a pedestrian
route.

7.    "Road" — any street, highway, avenue, lane,
alley or viaduct or any segment or part of the length
thereof.

8.    "Subdivision" — the division or partition of a
lot, tract or parcel of land into two or more lots,
plots, sites, tracts, parcels or other divisions for the
purpose, whether immediate or future, of rental, sale or
building development, and shall include resubdivision,
but such term shall not include a bona fide division or
partition of land for agricultural purposes.

9.    "Suburban district" — the Montgomery County
Suburban District, as described in Section 68—1, and as
the same may be hereafter amended.

Sec. 2. A new Section 49-33A, title "Pedestrian
walkways and bicycle trails", is hereby added to Chapter
4 9, title "Streets and Roads", of the Montgomery County
Code 1972, to read as follows:

49-33A. PEDESTRIAN WALKWAYS, BIKEWAYS AND WHEELCHAIR
TRAFFIC

(A) IN THE INTEREST OF PROMOTING ALTERNATIVE MEANS
OF TRANSPORTATION AND ENHANCING THE HEALTH AND WELFARE OF
THE CITIZENS OF MONTGOMERY COUNTY, THE COUNTY EXECUTIVE,
IN COOPERATION WITH APPROPRIATE GOVERNMENT AGENCIES,
SHALL DEVELOP, AS SOON AS POSSIBLE AFTER THE EFFECTIVE
DATE OF THIS SECTION, A PLAN, WHICH SHALL INCLUDE
NECESSARY CAPITAL IMPROVEMENTS PROGRAMS FOR A SYSTEM OF
