COUNTY LOCAL LAWS

Roads", Montgomery County Code 1972, as amended, by
repealing and re—enacting with amendments Section 49—31
thereof, title "Definitions", and by adding thereto a new
Section 49—33A, title "Pedestrian Walkways and Bikeways";
to define the terms "Bikeways" and "Pedestrian Walkways";
to provide for a system of bikeways, pedestrian walkways,
bicycle and wheelchair ramps, and non—hazardous gratings
and openings to be phased into existing roads and
transportation systems throughout the county; and to
require such facilities to be constructed and maintained
along with the construction, reconstruction or relocation
of any county road unless such action would not be in the
interest of public safety, or would not be feasible, or
would be disproportionate in cost to the need therefor or
probable use thereof.

BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, that

Sec. 1. Section 49—31, title "Definitions", of the
Montgomery County Code 1972, is hereby repealed and
re—enacted with amendments to read as follows:

Sec. 49-31. Definitions.

For the purposes of this article, the following
words and phrases shall have the meanings respectively
ascribed to them by this section:

1.    "Bikeways" - all facilities that explicitly
provide for bicycle travel. The term "bikeways" includes
the following:

A.    Bicycle trail or path — a separated
right—of—way designated for the use of bicycles in which
crossflows by motorists are minimized.

B.    Bicycle lane — a restricted right-of—way
designated for the use of bicycles on which
through—travel by motor vehicles or pedestrians is not
allowed, but vehicle parking may be allowed and on which
cross—flows by motorists, for example, to gain access to
parking facilities or associated land use, may be
allowed.

C.    Bicycle route - a shared right—of—way
designated as such by signs placed on vertical posts or
stencilled on the pavement and which shares its
through—traffic right—of—way with motor vehicles and
pedestrians.

2.    "Construction and constructed" — such terms
shall include "reconstruction" and "reconstructed", but
shall not include "maintenance".
