(i) Credited service for prior military service.
Upon completion of five years of service for each member
appointed prior to June 30, 1970 or five years of
continuous service for each member appointed on or after
July 1, 1970, each member who does not qualify for
credited service under the provisions of Section
33—41(c)(1) and (2), may obtain credited service for all
or part of any period of military service in the Armed
Forces of the United States not in excess of thirty—six
months. This option for purchase of such service credits
must be exercised by a member with five or more years of
qualified service by September 30, 1972. Thereafter this
option must be exercised by a member within thirty days
of the fifth anniversary of continuous service as a
County employee. Any member transferring from Retirement
Group D to Retirement Group E on or before September 30,
1972 and any member having five or more years of service
as of September 30, 1972 may purchase up to four years of
credited service. Any compensatory leave payments or
cash payments, including interest charges that may be in
excess of the amount that would be payable under the
revised provisions of this section shall be returnable
immediately to such member with four percent interest.
(j) Payment of Contributions for credited service
for prior military service. Before being credited for
this service, a member shall pay, in a lump sum or on an
extended payment basis, an amount determined by
multiplying the salary paid the member on the day before
the fifth anniversary of service, by the member's group
contribution rate, multiplied by each full year of
military service the member wishes to purchase. For each
period of less than one year, a pro-rata amount must be
paid. In addition, the member shall pay on such sum four
percent interest per annum from the date of the fifth
anniversary of service to July 1, 1970. Thereafter,
interest at the rate of six and one—half percent per
annum will be charged to date of full payment. If a
member wishes to purchase credited service on an extended
payment basis, approval of the County Personnel Board
must be obtained.
(m) Use of compensatory lea e and annual leave in
payment for credited service. As provided in the
Personnel Regulations, compensatory leave and annual
leave may be used in payment for credited service.
Lapsed salary monies of a member's department may be used
for these payments. This option must have been exercised
by July 30, 1972.
(p) Transfers to County Retirement System. Any
person who has not attained age sixty and is a member of
the Employees' Retirement System of the State of
Maryland, the Teachers' Retirement System of the State of
