be conducted under his supervision, and such data as he
may specify to be recorded before approval of an
application to install a water supply. Such data shall
become a part of the application.
(c) When, upon review of the application, the
Director is satisfied that the proposed design and
location is satisfactory, a written permit to proceed
with construction shall be issued; or, if unsatisfactory,
he shall deny the permit for construction.
(d) Any defects or noncompliance with regulations
or the terms of the permit found during inspection shall
be corrected within ten days from date of notification.
Notification shall be deemed to have been made by
placement of a notice of defect on the site.
(e) Prior to the issuance of any permit under this
section, the applicant shall pay to Montgomery County a
fee in accordance with the schedule of fees established
by the County Executive. The schedule of fees
established under this section may be revised from time
to time by the County Executive to an amount not to
exceed the reasonable cost of administering and enforcing
the provisions of this Chapter. Whenever the schedule of
fees is revised pursuant to this subsection, the County
Executive shall notify the County Council in writing of
the revised fee schedule.
SECTION 3. Section 45-9, titled "Excreta disposal
plants—Rules and regulations generally; permit fee," of
Chapter 45, title "Sewers, Sewage Disposal and Drainage,"
of the Montgomery County Code 1972, is hereby repealed
and re-enacted, with amendments to read as follows:
45—9. Excreta disposal plants—Rules and regulations
generally; permit fee.
The Board of Health and the County shall, from time
to time, adopt rules, regulations and specifications for
the construction, reconstruction and maintenance of
excreta disposal plants; and for suitability of the land
for the installation of such disposal plants by reason of
land area available for the system, topography and soil
conditions. The County Executive may impose and revise
from time to time reasonable and uniform fees for the
issuance of excreta disposal permits to cover the cost of
inspection.
SECTION 4. Severability.
The provisions of this Act are severable and if any
provision, sentence, clause, section or part thereof is
held illegal, invalid or unconstitutional or inapplicable
