AN ACT to amend Chapter 19, title "Excavation,
Stripping, Grading, and Fills", Chapter 24, title "Health
and Sanitation", and Chapter 45, title "Sewers, Sewage
Disposal and Drainage", of the Montgomery County Code
1972, by repealing and re—enacting, with amendments,
Section 19-7, title "Fees", Section 24-15, title
"Permits", and Section 45-9, title "Excreta disposal
plants — Rules and regulations generally; permit fee"; to
provide authority for the County Executive to establish
and revise, by written regulation, a schedule of fees
associated with the administration of programs to
regulate the grading of land and the installation and
maintenance of wells and septic systems, such fees not to
exceed the reasonable cost of administering said
programs.
BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, that -
SECTION 1. Section 19-7, Chapter 19, title,
"Excavation, Stripping, Grading, and Fills," of the
Montgomery County Code 1972, is hereby repealed and
re—enacted, with amendments, to read as follows:
19-7. Fees.
The permit and inspection fee shall be paid to the
Department and shall be computed on the basis of 2/10
cent (2 mills) per square foot of that area affected by
the land disturbing activity. The County Executive by
written regulation, adopted pursuant to Section 2—28 of
this Code, may increase or decrease such fees and set
non—refundable fee schedules for filing, additional
submissions, and permit renewals to an amount not to
exceed the reasonable cost of administering and enforcing
this Chapter.
SECTION 2. Section 24-15, titled "Permits," of
Chapter 24 titled, "Health and Sanitation" of the
Montgomery County Code 1972, is hereby repealed and
re—enacted, with amendments to read as follows:
24-15. Permits.
(a) No well shall be drilled, constructed or
placed into operation without a permit issued by the
department. Application for a permit shall be on forms
designated by the Director and may include submission of
plans, which shall become an integral part of the
application, to be approved by the Director.
(b) The Director may require pertinent tests, to
