COUNTY LOCAL LANS

The County Council hereby declares that an
emergency exists and that this legislation is necessary
for the immediate protection of the public health and
safety. Therefore, this emergency legislation shall take
effect on the date on which it becomes law.

Chapter 13

Bill No. 22-73

AN ACT to amend Chapter 11, title "Consumer
Protection," of the Montgomery County Code 1972, by
repealing and re-enacting, with amendments. Section 11-1,
title "Definitions," subsection (d) of Section 11—2,
title "Office of Consumer Affairs," Section 11-5, title
"Exemptions from Chapter" and subsection (a) of Section
11—7, title "Procedures and Enforcement," to define real
estate and real estate transactions and to include real
estate as a consumer good for the purpose of authorising
the filing of complaints concerning violations of the
consumer protection law in connection with the sale of
real estate, dwellings or other structures; to authorize
the office of consumer affairs to receive such complaints
and administer and assure enforcement of the provisions
of the consumer protection law pertaining to real estate
transactions; to authorize the office of consumer affairs
to refer complaints to and cooperate with the Maryland
Real Estate Commission on matters within their respective
jurisdictions; to delete real estate brokers from the
classification of professional services excluded from the
application of Chapter 11 of the Montgomery County Code
1972; and to clarify that the jurisdiction of the office
of consumer affairs does not extend to defective
tenancies arising out of a landlord-tenant relationship
governed by Chapter 29 of the Montgomery County Code
1972.

BE IT ENACTED BY THE COUNTY COUNCIL OF MONTGOMERY
COUNTY, MARYLAND, that -

Sec. 1. Section 11—1 of Chapter 11, title "Consumer
Protection," of the Montgomery County Code 1972, is
hereby repealed and re—enacted, with amendments, to read
as follows:
