MONTGOMERY COUNTY

WHICH RENT RELIEF IS CLAIMED.

(C)          ONLY ONE CLAIMANT PER HOUSEHOLD SHALL BE
ENTITLED TO RENT RELIEF IN LIEU OF TAX CREDITS UNDER
THIS CHAPTER.

(D)             THE RIGHT TO FILE A CLAIM UNDER THIS
CHAPTER SHALL BE PERSONAL TO THE CLAIMANT AND SHALL NOT
SURVIVE THE CLAIMANT'S DEATH, BUT SUCH RIGHT MAY BE
EXERCISED ON BEHALF OF A CLAIMANT BY THE CLAIMANT'S LEGAL
GUARDIAN OR ATTORNEY-IN-FACT. IF A CLAIMANT DIES AFTER
HAVING FILED A TIMELY CLAIM, THE AMOUNT THEREOF SHALL BE
DISBURSED TO ANOTHER MEMBER OF THE HOUSEHOLD AS
DETERMINED BY A COURT OF COMPETENT JURISDICTION. IF THE
CLAIMANT WAS THE ONLY MEMBER OF THE HOUSEHOLD, THE CLAIM
MAY BE PAID TO THE CLAIMANT'S EXECUTOR OR ADMINISTRATOR,
BUT IF NEITHER IS APPOINTED AND QUALIFIED WITHIN TWO
YEARS OF THE FILING OF THE CLAIM, THE AMOUNT OF THE CLAIM
SHALL ESCHEAT TO MONTGOMERY COUNTY.

(E)           NO CLAIM UNDER THIS CHAPTER SHALL BE
ALLOWED TO ANY PERSON WHO HAS RESIDED FOR MORE THAN SIX
MONTHS IN PROPERTY WHICH IS EXEMPT FROM MONTGOMERY COUNTY
PROPERTY TAXES DURING THE YEAR FOR WHICH THE CLAIM IS
FILED.

41A-4 RENT RELIEF, NATURE AND AMOUNT

(A)          RENT RELIEF UNDER THIS CHAPTER SHALL BE
IN THE FORM OF DIRECT GRANTS PAID BY THE COUNTY DIRECTOR
OF FINANCE TO QUALIFIED CLAIMANTS.

(B)          A TENANT SHALL BE ELIGIBLE FOR SUCH RENT
RELIEF IF THE TOTAL INCOME OR COMBINED TOTAL INCOME OF
THE TENANT DOES NOT EXCEED $10,000 FOR THE CALENDAR YEAR
IMMEDIATELY PRECEDING THE YEAR IN WHICH THE CLAIM IS
FILED.

(C)          THE AMOUNT OF THE RENT RELIEF SHALL BE
TWO AND EIGHT-TENTHS PERCENTUM (2.8%) OF THE DIFFERENCE
BETWEEN $14,000 AND THE TOTAL INCOME OR COMBINED TOTAL
INCOME.

(D)           A TENANT WHOSE TOTAL INCOME OR COMBINED
TOTAL INCOME FOR THE IMMEDIATELY PRECEDING CALENDAR YEAR
WAS IN EXCESS OF $10,000 SHALL BE ENTITLED TO RENT RELIEF
AS SPECIFIED IN PARAGRAPH (C) HEREOF, BUT SUCH RENT
RELIEF SHALL BE REDUCED BY TWENTY-FIVE PERCENTUM (25%) OF
THE EXCESS OF SUCH INCOME ABOVE $10,000. THE RELIEF SHALL
BE PRORATED ACCORDING TO THE NUMBER OF MONTHS THE
CLAIMANT WAS A TENANT IN MONTGOMERY COUNTY DURING THE
CALENDAR YEAR FOR WHICH RENT RELIEF IS CLAIMED. A MONTH
SHALL NOT BE COUNTED IN WHICH THE CLAIMANT IS A RECIPIENT
OF PUBLIC FUNDS FOR THE PAYMENT OF RENT OR THE CLAIMANT
