to any person or circumstances, such illegality,
invalidity or unconstitutionality, or inapplicability
shall not affect or impair any of the remaining
provisions, sentences, clauses, sections or parts of this
Act or their application to other persons or
circumstances. It is hereby declared to be the
legislative intent that this Act would have been adopted
if such illegal, invalid or unconstitutional provision,
sentence, clause, section or part had not teen included
therein, and if the person or circumstances to which the
Act or any part thereof is inapplicable had been
specifically exempted therefrom.
Section 3. Effective date.
This Act shall take effect on the 76th day following
the date on which it becomes law.

AN ACT to repeal in its entirety Section 24—9, title
"Board of Community and Mental Health" - Established;
Membership; Appointments, Qualifications, Term of Office
and Compensation of Members; Officers; Meeting; Annual
Reports" and Section 24—10, title "Same—Duties", of
Chapter 24, title "Health and Sanitation", Montgomery
County Code 1972, and to enact in lieu thereof a new
Article III, title "Comprehensive Health Planning", to
Chapter 24, consisting of Sections 24—22, through 24-33,
relating generally to comprehensive health planning
within Montgomery County; to establish a Comprehensive
Health Planning Advisory Board to be appointed by the
County Executive, subject to confirmation by the County
Council, and to set forth the duties and responsibilities
of the Board; to authorize the establishment of a
Comprehensive Health Planning Staff as a part of the
Executive Branch of County Government separate and apart
from the Health Department or any other agency or
department having health related functions and to provide
for the appointment of a staff director and supporting
staff; to provide for the development and periodic
revision of a comprehensive health plan for the County;
and to specify a process for review and decision—making
on proposals and applications relating to comprehensive
health planning in the County, said decision—making
process to involve the Comprehensive Health Planning
