AN ACT to effect the following changes in the CATV act
enacted by Bill No. 89, 1972 (codified as Sections
2-15.1 through 2-15.26 of the Baltimore County Code
(1972 Cumulative Supplement) as amended by Bill No.
13, 1973 to provide the procedure for the County to
exercise its option to renew the franchise, to waive
free service on additional access channels, to
provide that council approval of nonsubscriber rates
be as permitted by the Federal Communications
Commission, to raise the amount of cash security to
be deposited by the company during the term of its
franchise and to require the company to post a
performance bond in addition to said cash security,
by repealing and re—enacting with amendments
subsections 2-15.3(b), 2-15.5(d), 2-15.7(c) and (g),
2-15.14(a) and (b) of the Baltimore County Code,
1968, (1972 Cumulative Supplement) as amended by
Bill No. 13, 1973, title "Administration", Article
I. In General.

SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
BALTIMORE COUNTY, MARYLAND, that subsection 2-15.3(b) of
the Baltimore County Code, 1968, (1972 Cumulative
Supplement), title "Administration", Article I. In
General, be and it is hereby repealed and re—enacted with
amendments, to read as follows:

Section 2—15.3 Non—Exclusive Franchise

(b) The franchise shall become effective on the
date on which the Council notifies the Company that the
franchise has been awarded, pursuant to this Act and in
conformance with the County Code. The franchise shall
remain in effect for fifteen (15) years, unless sooner
terminated as hereinafter provided. The Company shall
have the option to [continue operations, for a further
ten year period, subject to the approval of the County
Council which] APPLY IN WRITING AT LEAST SIX MONTHS PRIOR
TO THE EXPIRATION OF THE FRANCHISE TO CONTINUE OPERATION
FOR A FURTHER TEN YEAR PERIOD WHICH RENEWAL IS CONTINGENT
UPON A SHOWING AT A PUBLIC HEARING TO THE COUNTY'S
SATISFACTION THAT THE FRANCHISEE REMAINS FULLY QUALIFIED
AND HAS SATISFACTORILY PERFORMED UNDER THE ORDINANCE.
SUBJECT TO THESE CONDITIONS THE GRANT OF A RENEWAL BY THE
COUNTY COUNCIL shall not be arbitrarily withheld.

SECTION 2. BE IT FURTHER ENACTED, that subsections
2-15.5(d), 2-15.7(c) and (g), 2-15.14(a) and (b) of said
Code, title and article, as amended by Bill No. 13, 1973,
be and they are hereby repealed and re-enacted with
amendments, to read as follows:
