BALTIMORE COUNTY

CHARGES THEREAFTER FOR THE COUNTY CHANNEL(S) AND THE
SCHOOL SYSTEM CHANNEL(S) SHALL BE THE MINIMUM CONSISTENT
WITH THE THEN EXISTING RULES AND REGULATIONS OF THE FCC.
In addition, the Company will provide one,
non—commercial, Public Channel without charge, EXCEPT AS
MAY BE PERMITTED BY FCC, to County residents. Additional
channels, made available on a public—access basis, may be
leased by the Company on rates, terms and conditions to
be approved, in advance, by the County, as provided in
Subsection (c) herein.

Section 2—15.8 Annual fees and compensation to the
County

(a) The Company shall pay the County an initial
annual fee of three percent (3%) of its [gross receipts]
SUBSCRIBER REVENUES AS DETERMINED BY THE FCC. If
subsequent to the granting of this franchise, the FCC
authorizes and/or approves an increase in the annual fee
over and above the three percent (3%) rate, AND/OR
CHANGES ITS DETERMINATION OF THE TERM "SUBSCRIBER
REVENUES" the Company shall pay the County said increased
fee, upon notification of the Company by the Council.
The said annual compensation shall be paid on or before
March 15 at the time of filing the annual financial
report for the preceding calendar year.

SECTION 3. BE IT FURTHER ENACTED, that new Section
2—15.27 be and is hereby added to said Code and Article,
as amended; said new section to read as follows:

Section 2—15.27 FCC changes to be part of franchise

It is understood that should the FCC modify, change
or alter any of its provisions as to franchise
standards, such modification, change or alteration shall
be incorporated into any franchise issued hereunder
within one year of adoption by the FCC of the
modification, change or alteration, or at the time of
franchise renewal, whichever occurs first.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act
is hereby declared to be an emergency measure affecting
the public health, safety or welfare, and having been
passed by the affirmative vote of five members of the
County Council, the same shall take effect from the date
of its enactment.
