BALTIMORE COUNTY

"Administration", Article I. In General, be and it is
hereby repealed.

SECTION 2. AND BE IT FURTHER ENACTED, that
subsection 2-15.4(a), (b) and (c) , 2-15.5(d) and (g),
2-15.7(f) and (g) and 2-15.8(a) of said code and article,
as amended, be and they are hereby repealed and
re—enacted with amendments, all to read as follows:

Section 2—15.4 Construction and Installation of the
System

(a)    Upon commencement of the operation of the
system, it shall be capable of transmitting at least
[twenty-four (24) channels] TWENTY (20) CHANNELS, OR AS
MAY BE CONSISTENT WITH THE RULES AND REGULATIONS OF THE
FCC for delivery to Residential Subscribers. Said
services are to be rendered to public or quasi public
facilities or buildings without charge. In addition, the
system will be construction with the capability of
providing two-way or "return" communications.

(b)     The Company shall provide all Residential
Subscribers to Basic Service and all Public or Quasi
Public Facilities with a converter, with no less than
[24] 20-channel, OR AS MAY BE CONSISTENT WITH THE RULES
AND REGULATIONS OF THE FCC capacity as hereinabove
referred, for each television receiver that is connected
to the system. The Company shall supply such converters
for a charge or deposit that shall not exceed the
Company's cost for same.

(c) The Company shall construct [and/or extend the
installation of its System, through the County, in the
manner and in accordance with the timetable set forth in
the franchise. It shall commence construction no later
than one year from the effective date of the franchise,
or within one year after final, legal resolution of any
approvals, or actions that may be required by the FCC,
whichever is later, and shall have completed or
substantially completed construction within five (5)
years from the date on which construction is commenced.
"Substantially complete construction" shall mean herein
the ability to provide Basic Service to all areas
throughout the County in which the density of Residential
Subscribers is 100 or more per square mile.] AT LEAST 20%
OF THE COUNTY WITH ENERGIZED AND OPERABLE TRUNK CABLE
WITHIN THE FIRST YEAR AFTER THE ISSUANCE OF THE OF THE
CERTIFICATE OF COMPLIANCE BY THE FCC. THEREAFTER THE
COMPANY SHALL EXTEND THE ENERGIZED TRUNK CABLE AT LEAST
20% EACH YEAR UNTIL THE ENTIRE SYSTEM IS BUILT IN THE
COUNTY PROVIDING BASIC SERVICE TO ALL AREAS THROUGHOUT
