COUNTY LOCAL LAWS

Bill No. 90-74

AN ORDINANCE to add new Sections 1-283 through
1—286, inclusive, to the Anne Arundel County Code (1967
Edition and Supplements), Title 1, "Administration",
Subtitle 2, "Personnel", to follow immediately after
Section 1—282 thereof, and to be under the new Article
VI, "Deferred Compensation Plan", to establish a deferred
compensation plan for all County employees; to define the
term "employee" as used in said plan; to establish the
provisions and administration of said plan; and matters
generally related thereto.

SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That Sections 1-283
through 1—286, inclusive, be and they are hereby added to
the Anne Arundel County Code (1967 Edition and
Supplements), Title 1, "Administration", Subtitle 2,
"Personnel", to follow immediately after Section 1—282
thereof, and to be under the new Article VI, "Deferred
Compensation Plan", and to read as follows:

ARTICLE VI - DEFERRED COMPENSATION PLAN

SECTION 1-283

(A)    THE PERSONNEL OFFICER IS HEREBY AUTHORIZED TO
ESTABLISH AND ADMINISTER A DEFERRED COMPENSATION PROGRAM
AND MAY, BY CONTRACT, ENTER INTO VOLUNTARY WRITTEN
AGREEMENT WITH ANY EMPLOYEE TO DEFER IN WHOLE OR IN PART
ANY PORTION OF THE EMPLOYEE'S COMPENSATION. FOR PURPOSES
OF THIS ARTICLE, THE TERM "EMPLOYEE" SHALL MEAN ANY
PERSON, INCLUDING PERSONS ELECTED OR APPOINTED, PROVIDING
SERVICES FOR ANNE ARUNDEL COUNTY FOR WHICH COMPENSATION
IS PAID.

(B)    THE PERSONNEL OFFICER IS ALSO AUTHORIZED TO
ADOPT A MASTER PLAN FOR SAID PROGRAM, TO ADOPT SUCH RULES
AND REGULATIONS AS MAY BE NECESSARY OR DESIRABLE; TO
NEGOTIATE WITH A PRIVATE FIRM ABLE AND QUALIFIED TO
PROVIDE CONSOLIDATED BILLING SERVICES, PARTICIPANT
ENROLLMENT SERVICES, PARTICIPANT ACCOUNTS AND OTHER
RELATED SERVICES AS PLAN ADMINISTRATOR. SAID MASTER PLAN
SHALL BE APPROVED BY THE INTERNAL REVENUE SERVICE PRIOR
TO IMPLEMENTATION.
