ANNE ARUNDEL COUNTY

ANNE ARUNDEL COUNTY, MARYLAND, That Sections 13-304.1(2)
and 13-305.1(1) of the Anne Arundel County Code (1967
Edition and Supplements), Title 13, "Planning and
Zoning", Subtitle 3, "Alternate Zoning Regulations",
Article III, "Residential Districts", Headings, "R1 -
Residential Districts" and "R2 — Residential Districts",
and Section 13-313.17 of said Code, Title and Subtitle,
Article XI, "Special Exceptions", Heading, "Specific
Standards", Subheading, "Other Special Exceptions", be
and they are hereby repealed and re—enacted, with
amendments, to read as follows:

Section 13-304. 1.

(2) All uses set forth in section 13—303.2 except
heliports, [kennels,] sand, gravel, borrow and clay pits
and sanitary landfills.

Section 13-305. 1.

ft) All uses set forth in section 13—304.1, with
the exception of airports, airfields, animal hospitals,
heliports and helipads, commercial recreational
campgrounds, commercial recreational establishments,
KENNELS and rifle, pistol, skeet and archery ranges.

Section 13-343.17.

(A)   Kennels shall be permitted in RA - Agricultural
Residential Districts, provided;

(1)   Buildings, enclosures, coops and runs for
the housing or shelter of animals shall be located not
less than one hundred feet (100') from any residential
property line; no animals may be housed within said
setback.

(2)   Said facility shall be screened from
residences in accordance with the provisions of section
13-300.11.

(3)   Said use shall not create a nuisance to
surrounding residential properties.

(B)    KENNELS SHALL BE PERMITTED IN R1 - RESIDENTIAL
DISTRICTS SUBJECT TO THE PROVISIONS SET FORTH IN
SUBSECTION (A) HEREOF, AND PROVIDED THAT SAID FACILITY
SHALL BE LOCATED ON A SITE OF NOT LESS THAN THREE (3)
ACRES.

SECTION 2. AND BE IT FURTHER ENACTED, That if any
provision of this Ordinance or the application thereof to
any person or circumstance is held invalid for any
