AN ACT to add new Section 700 to Code of Public
Local Laws of Kent County (1967 Edition and 1970
Supplement being Article 15 of the Code of Public Local
Laws of Maryland) title "Kent County" subtitle "County
Commissioners" to provide for the recreation of a
Planning Commission for Kent County and providing for its
membership and compensation and defining the duties and
powers of such Commission to pass as an Emergency Bill.
SECTION I. BE IT ENACTED BY THE BOARD OF COUNTY
COMMISSIONERS OF KENT COUNTY, MARYLAND, That new Section
7 00 be and is hereby added to the Code of Public Local
Laws of Kent County (1957 Edition and 1970 Supplement
being Article 15 of the Code of Public Local Laws of
Maryland), title "Kent County" subtitle "County
Commissioners" to read as follows:
700. COMMISSION CREATED. THE PLANNING COMMISSION SHALL
BE AND IS HEREBY CREATED FOR KENT COUNTY, MARYLAND, IN
ACCORDANCE WITH SECTION 3.01 OF ARTICLE 66B OF THE
ANNOTATED CODE OF MARYLAND, (1957 EDITION AS AMENDED);
THE NAME OF THE SAID PLANNING COMMISSION SHALL BE "KENT
COUNTY PLANNING COMMISSION".
A. MEMBERSHIP. THE PLANNING COMMISSION SHALL
CONSIST OF FIVE MEMBERS AS FOLLOWS:
A COUNTY COMMISSIONER OF KENT COUNTY TO BE
APPOINTED BY THE COUNTY COMMISSIONERS TO SERVE AS AN
EX-OFFICIO MEMBER. THE EX-OFFICIO MEMBER SHALL VOTE ONLY
IN THE CASE OF A TIE VOTE BY THE FOUR OTHER MEMBERS.
FOUR OTHER MEMBERS SHALL BE APPOINTED BY THE KENT COUNTY
COMMISSIONERS. MEMBERS SHALL BE SELECTED ON THE BASIS OF
THEIR EXPERIENCE AND QUALIFICATIONS.
B. TERM OF OFFICE. TERM OF OFFICE FOR EACH
MEMBER SHALL BE FIVE YEARS, OR UNTIL HIS SUCCESSOR TAKES
OFFICE, EXCEPT THAT THE RESPECTIVE TERMS OF THE FOUR
MEMBERS FIRST APPOINTED SHALL BE ON A STAGGERED BASIS.
ON THE INITIAL APPOINTMENT, ONE SHALL SERVE FOR A PERIOD
OF TWO YEARS, ONE FOR THREE YEARS AND ONE FOR FOUR YEARS,
AND ONE FOR FIVE YEARS.
THE EX-OFFICIO MEMBER SHALL SERVE FOR THE TERM
