RESOLUTION (CHARTER) NO. 1974-5
RESOLUTION OF THE MAYOR AND CITY COUNCIL
OF OCEAN CITY, MARYLAND TO AMEND THE
TOWN CHARTER
BE IT RESOLVED by the Mayor and City Council of
Ocean City, Maryland, pursuant to the authority of
Sections 11 through 18 of Article 23A of the of the
Annotated Code of Maryland, (1973 Replacement Volume) to
amend, and the same hereby is amended, Subsection A of
Section 177 (now codified as Code Section C—408,
Subsection A) of the Municipal Charter of the Town of
Ocean City, Maryland, by eliminating from said Subsection
of said Charter the matter hereinafter enclosed in double
parentheses, and by adding to said Subsection the new
matter hereinafter underscored, as follows:
"C—408 Vacancies in Office of Mayor or City
Councilman." (177)
A. If any person so elected as Mayor refuses to
serve or if his office shall become vacant by death,
resignation, disqualification or otherwise, his office
shall be filled by the duly elected President of the City
Council [and the remaining councilmen shall, by
appointment, fill the vacancy on the Council created by
the appointment of the President of the City Council as
Mayor, as early as possible, from among the qualified
voters of the said town eligible to serve as Councilman,
and the person so appointed shall fill the unexpired term
of the councilman who has been appointed Mayor]. At the
next regular meeting following the [appointment] FILLING
OF THE MAYOR'S OFFICE, the Councilmen shall elect one (1)
of their number as President, who shall preside at the
meetings of the Mayor and Council. ALL VACANCIES OF
COUNCILMAN OFFICES SHALL BE FILLED BY THE HOLDING OF A
SPECIAL ELECTION WITHIN NINETY DAYS OF THE OCCURRENCE OF
SUCH A VACANCY PROVIDED THAT NO SUCH SPECIAL ELECTION
SHALL BE NECESSARY IF THE REGULAR ELECTION DATE WILL
OCCUR WITHIN ONE HUNDRED FIFTY (150) DAYS OF THE
