ORDINANCE NO. CA-11-74

REPEALING PARAGRAPH 21. j.(4) AND AMENDING
PARAGRAPH 21. j(5) OF THE CITY CHARTER SO AS
TO CONFORM THE CHARTER TO STATE LAW AS TO
APPEALS FROM DECISIONS OF THE BOARD OF
APPEALS.

BE IT ORDAINED by the Mayor and Council of
Gaithersburg, in public meeting assembled, that:

1.    Section 21. j. (4) of the Charter is hereby
repealed.

[(4) Any person or persons, jointly or
severally aggrieved by any decision of the Board of
Appeals, or any taxpayer, or any officer, department,
board, bureau of the City may appeal the same to the
Circuit Court of the County].

2.    Section 21. j.(5) of the Charter is hereby
amended to read as follows:

(5) An appeal may be taken FROM ANY DECISION
OF THE BOARD OF APPEALS to the Circuit Court for
Montgomery County and from there to the Court of Appeals
of Maryland, IN ACCORDANCE WITH SECTION 4.08 OF ARTICLE
66B OF THE ANNOTATED CODE OF MARYLAND (1957 EDITION AS
AMENDED) [during the period and in the manner prescribed
by rules of the Court of Appeals, from any decision of
the Board of Appeals].

Adopted by the City Council of Gaithersburg this

AMENDING SECTIONS 58 AND 60 OF THE CHARTER SO
AS TO AUTHORIZE THE APPOINTMENT OF ASSISTANT
CITY ATTORNEYS AND TO PROVIDE THAT THEY NOT BE
INCLUDED WITHIN THE MERIT SYSTEM.
