ORDINANCE NO. CA-4-74

AMENDING SECTIONS 7 AND 78a OF THE CITY
CHARTER TO DELETE SUPERFLUOUS WORDS.

BE IT ORDAINED by the Mayor and Council of
Gaithersburg, in public meeting assembled, that:

1.    Section 7 of the Charter is amended to read as
follows:

The Council shall be the judge of the election
and qualification of its members [to any other persons].

2.    Section 78a of the Charter is amended to read
as follows:

a. Before entering upon the duties of their
offices, the Mayor, the Councilmen, the City Manager, and
the members of the Board of Supervisors of Elections, the
Planning Commission and the Board of Appeals shall take
and subscribe to the following oath or affirmation: "I,
, do swear (or affirm as the case may be), that I
will support the Constitution of the United States; and
that I will be faithful and bear true allegiance to the
State of Maryland, [and support the Constitution of the
United States; and that I will be faithful and bear true
allegiance to the State of Maryland,] and support the
Constitution and Laws thereof; and that I will, to the
best of my skill and judgment, diligently and faithfully,
without partiality or prejudice, execute the office of

_________, according to the Constitution and Laws of this

State."

Adopted by the City Council of Gaithersburg this
18th day of March, 1974.

ORDINANCE NO. CA-5-74

AMENDING SECTION 8 OF THE CHARTER TO PROVIDE
THAT THE VICE PRESIDENT OR PRESIDENT PRO-TEM
OF THE COUNCIL BE ENTITLED TO VOTE WHEN ACTING
AS PRESIDENT OF THE COUNCIL IN THE ABSENCE OF
THE MAYOR.
