Maryland as fully as if said provisions had been herein
incorporated. The said Water Board shall have power to
enter into contracts for building said water distribution
system, to contract for material therefor, to employ all
necessary labor and clerks and to fix their compensation.
They shall make such other necessary rules and
regulations for the construction, management and
maintenance of said water distribution system. They
shall establish rates for water service, and shall make a
semi—annual report of their proceedings and of the
condition of said system to the MAYOR AND COUNCIL
[Burgess and Commissioners] of Funkstown. The four
persons appointed to said Water Board shall be appointed
for the term of one, two, three and four years,
respectively, as to the first appointees, and their
successors shall be appointed for the term of four years.
Any member of the Water Board shall be eligible for
reappointment and the MAYOR [Burgess] of said town for
the time being shall always be ex officio a member of
said Water Board.
SECTION 2. AND BE IT FURTHER RESOLVED, That this
Resolution shall become effective on the fiftieth day
after being adopted or passed, unless a proper Petition
for referendum hereon shall be filed as permitted by law.

ORDINANCE NO. CA-1-74
AMENDING SECTIONS 3 AND 14 OF THE CITY CHARTER
TO PROVIDE THAT THE TERM OF OFFICE OF EACH
COUNCILMAN AND THE MAYOR SHALL EXPIRE ON THE
FIRST MONDAY FOLLOWING THE ELECTION OF HIS
SUCCESSOR.
BE IT ORDAINED by the Mayor and Council of
Gaithersburg, in public meeting assembled, that:
1. Section 3 of the Charter is amended to read as
follows:
All legislative powers of the City shall be
vested in a Council consisting of five Councilman who
shall be elected as hereinafter provided and who shall[,
except as hereinafter provided,] hold office for a term
